{"id":1212,"date":"2024-05-29T12:17:31","date_gmt":"2024-05-29T12:17:31","guid":{"rendered":"https:\/\/staging.www.selfpay.ro\/?page_id=1212"},"modified":"2026-04-02T16:03:57","modified_gmt":"2026-04-02T16:03:57","slug":"terms-and-conditions","status":"publish","type":"page","link":"https:\/\/www.selfpay.ro\/en\/legal\/selfpay-now\/terms-and-conditions\/","title":{"rendered":"Legal &#8211; SelfPay Now &#8211; Terms and conditions"},"content":{"rendered":"<p><strong>IDTERMS AND CONDITIONS OF USE OF THE SELFPAY NOW MOBILE APPLICATION\u00a0 <\/strong><\/p>\n<p><strong>(Terms of Use)<\/strong><\/p>\n<ol>\n<li><strong> Terms of Use<\/strong><\/li>\n<\/ol>\n<p>These terms of use (&#8220;<strong>Terms of Use<\/strong>&#8220;) encompass the terms and conditions of use of the SelfPay Now mobile application (&#8220;<strong>SelfPay Now Application<\/strong>&#8221; or &#8220;<strong>Application<\/strong>&#8220;) and the features provided to you (&#8220;<strong>you<\/strong>&#8220;, &#8220;<strong>user<\/strong>&#8220;), in order to make money transfers (&#8220;<strong>P2P Transfer<\/strong>&#8220;) and\/or replenish your cards with cash at SelfPay Payment Stations (&#8220;<strong>Cash2Card Transfer<\/strong>&#8221; and together with the P2P Transfer hereinafter referred to as &#8220;<strong>Services<\/strong>&#8220;). You can view this document at any time through the SelfPay Now Application, on the website <a href=\"http:\/\/www.selfpay.ro\">www.selfpay.ro<\/a> or you can send us a request at any time to the contact addresses provided below in order to obtain an electronic copy.<\/p>\n<p>The SelfPay Now application is made available to you by <strong>Selfpay SA<\/strong>, a company headquartered in Bucharest, 153-155 E Dacia Boulevard, 2nd district, Romania, registered with the Trade Register Office under number \u00a0J2009009919407, having the sole identification number RO26067497 (hereinafter referred to as &#8220;<strong>SelfPay<\/strong>&#8220;).<\/p>\n<p>The services Cash2Card and P2P transfer provided within the SelfPay Now Application are provided by <strong>Libra Internet Bank S.A<\/strong>., a company headquartered in Bucharest, 6-6A Calea Vitan, section B, C, 1st, 6th, 9th, 13th floor, Phoenix Tower building, 3rd district, Romania, registered with the Trade Register Office under number J40\/334\/1996, having the sole identification number 8119644 and registered with the Register of Credit Institutions of the National Bank of Romania under no. RB-PJR-40-037 \/ 18.02.1999 (hereinafter referred to as the \u201c<strong>Bank<\/strong>\u201d).<\/p>\n<p>Through the SelfPay Now Application, the Bank initiates and processes the payment orders corresponding to the transfers that you make with the technical support of the SelfPay Now application.<\/p>\n<p>By using the Platform, you authorize the Bank to initiate and carry out transfers on your behalf by initiating payment orders. The initiation of the payment orders corresponding to the transfers requested by you through the Platform is carried out by the Bank.<\/p>\n<p>For each transfer operation initiated by you, the Platform provides the technical infrastructure for initiating the payment order by the Bank. Afterward, the payment instructions are validated by the Bank and transferred to Romcard. The verification of the conditions necessary for the processing of the transfer, including, but not limited to, the verification of the accounts involved in the transfer operation, the verification of the availability of the payer&#8217;s funds, and similar ones, is carried out by Romcard.<\/p>\n<p>By accepting these Terms of Use, you understand and confirm your consent to use the Application and the Services under the terms and conditions set forth in this document<\/p>\n<p>For any question regarding these Terms of Use, please contact us at the e-mail address: <a href=\"mailto:contact@selfpay.ro\">contact@SelfPay.ro<\/a> or\/and <a href=\"mailto:info@librabank.ro\">info@librabank.ro<\/a><\/p>\n<ol start=\"2\">\n<li><strong>General eligibility conditions<\/strong><\/li>\n<\/ol>\n<p>In order to create a user account for the use of Cash2card and P2P \u00a0Services available in the SelfPay Now Application, you must be at least 14 years old on the date of first use.<\/p>\n<p>In order to use the available Services, it is necessary to register your personal data and debit or credit cards according to the instructions set out on the registration page, including indicating your agreement to accept these Terms of Use at the time of creating the user account.<\/p>\n<p>In order to use the Cash2Card Transfer and P2P Transfer Services, you will have to successfully complete the remote identification process by video means available in the Application, which involves verifying your identity, based on the identity documents (for example identity card issued by the Romanian authorities) presented, the captured images and\/or the information communicated, using video means. For this purpose, we use the services of the remote video identification service provider Onfido and some of its subcontractors. For more details regarding the processing of personal data used for remote identification, please access and consult the document &#8220;Information note on the processing of personal data&#8221; available in the Application and on the www.selfpay.ro website.<\/p>\n<p>The user of the SelfPay Now Application undertakes the responsibility that he\/she will not violate the provisions of these Terms of Use, which include the following rules:<\/p>\n<p>a) you will not use a card blocked by the financial institution issuing the card;<\/p>\n<p>b) you will be able to enroll a maximum of 3 active cards per user issued under the MasterCard or Visa logo; A particular card may be moved between not more than two separate accounts.<\/p>\n<p>c) both your cards and the cards of the beneficiary of a P2P Transfer are valid and are issued by financial institutions in Romania; The application also allows P2P Transfers and Cash2Card Transfers and between\/on cards that have an identification number (BIN) assigned to the payment instrument issuance services carried out in Romania by the institutions authorized for this purpose. Any cards with BIN corresponding to Romania, issued by banking institutions, payment institutions, electronic money institutions or other institutions authorized to issue payment instruments under Community and national regulations on payment services may be registered within the Application.<\/p>\n<p>d) both you and the beneficiary of a P2P Transfer carry out operations on personal devices and SIM cards issued by mobile operators in Romania or in other Member States of the European Union;<\/p>\n<p>e) both you and the beneficiary of a P2P Transfer are citizens or residents of the same country where the Application operates, respectively Romania;<\/p>\n<p>f) you have a mobile device with the Android or iOS operating system updated to the latest version available for your device;<\/p>\n<p>g) you will comply with the trading limits set out in Section 5.2 below.<\/p>\n<p>h) if you are a minor with limited capacity to exercise (persons who have reached the age of 14 but have not reached the age of 18), you have been assisted by and have obtained the authorization of your legal representatives (your parents\/guardian) to access the Application, use our services and to accept these Terms of Use, at least when the provisions of the Romanian Civil Code provide for the obligation to obtain the consent of legal representatives or other similar authorizations<\/p>\n<p>i) the enrollment of the card in the Application in order to use the services will be carried out exclusively by performing by you the Strict Customer Authentication procedure, or, as the case may be, by your legal representatives, an authentication and authorization procedure that involves the use of multiple security elements in accordance with the provisions agreed with the financial institution issuing the card.<\/p>\n<ol start=\"3\">\n<li><strong>Functionalities and Services<\/strong><\/li>\n<\/ol>\n<p>The Seflpay Now application facilitates users&#8217; access to the following Services:<\/p>\n<p>(a) <strong>P2P Transfer.<\/strong> This involves an instant* money transfer service from the sender&#8217;s card to the recipient&#8217;s card using the channels provided by the Visa and MasterCard card organizations, the Bank and SelfPay; The service is provided under the conditions of providing the services stipulated in these Terms of Use. You can use this service to transfer money to your own cards or to the card of another user of the Application.<\/p>\n<p>The payment recipient can be selected through the following methods:<\/p>\n<ol>\n<li style=\"list-style-type: none;\">\n<ol>\n<li><strong>Phone number<\/strong>: If it&#8217;s saved in the phone&#8217;s contacts, access the &#8220;Transfer&#8221; section from the main screen of the SelfPay Now app. Choose the desired number or enter the person&#8217;s name in the search field.<\/li>\n<li><strong>Alias<\/strong>: When personal data should remain private and the recipient is remote and has provided his\/her Alias. Access the &#8220;Transfer&#8221; section from the main screen of the SelfPay Now app and enter the received Alias in the same search field.<\/li>\n<li><strong>QR code<\/strong>: When personal data should remain private, the recipient is in proximity and can display a QR code, and access the &#8220;Transfer&#8221; section from the main screen of the SelfPay Now app. Select the &#8220;QR code&#8221; icon located in the search field.<\/li>\n<\/ol>\n<\/li>\n<\/ol>\n<p>The SelfPay Now application enables transfers only between its users, so when you want to make a transfer by accessing your contact list, you will be able to select only the phone numbers that are accompanied by the SelfPay Now symbol.<\/p>\n<p>* Important: The maximum crediting and debiting time for cards involved in P2P transactions depends on the correct implementation by the card issuing banks of the mandatory flows for the Visa Direct and Moneysend services, services offered by the card organizations, Visa and Mastercard. Transfers to credit cards usually require a processing period of up to 2 working days, in exceptional situations that do not depend on the SelfPay system, this period can be extended. Transfers between debit cards are usually made within a maximum of 30 minutes from their initiation, but may require a processing period of up to 2 working days, in exceptional situations that do not depend on the SelfPay system, this period can be extended.<\/p>\n<p>(b) <strong>Cash2Card Transfer.<\/strong> This involves an instant*\u00a0 funds transfer service on the application&#8217;s user card, using the channels provided by Visa and MasterCard card organizations, the Bank and SelfPay; The service is provided under the conditions of providing the services stipulated in these Terms of Use.\u00a0<\/p>\n<p>*Important: The maximum crediting time of the cards involved in Cash2Card transactions depends on the correct implementation by the card-issuing banks of the mandatory flows for the Visa Direct and Moneysend services, services offered by the card organizations, Visa and Mastercard. Transfers to credit cards usually require a processing period of up to 2 working days, in exceptional situations that do not depend on the SelfPay system, this period can be extended. Transfers between debit cards are usually made within a maximum of 30 minutes from their initiation, but may require a processing period of up to 2 working days, in exceptional situations that do not depend on the SelfPay system, this period can be extended.<\/p>\n<p>Through the SelfPay Payment Stations provided and operated by SelfPay, the user of the SelfPay Now Application can deposit funds directly on his own card enrolled in the Application. You can use this Cash2Card Transfer service to fund with money only your own card enrolled in the Application.<\/p>\n<p>The transaction status (found in the &#8220;Transaction Details&#8221;) is provided for informational purposes and is based on information submitted by SelfPay partners, information over which SelfPay has no control. For SelfPay,\u00a0 the moment when the transaction is considered as successfully completed is when the recipient of the funds has access to them.<\/p>\n<p>The funds we refer to may be (i) in the form of cash; or (ii) in the form of a change voucher that you have received from SelfPay as a result of your previous use of the Cash2Card service or other SelfPay services made available to you through Payment Stations.<\/p>\n<ol start=\"4\">\n<li><strong>Opening the account and using the Application<\/strong><\/li>\n<\/ol>\n<p>The flow of opening a user account in the Application, as well as enrolling the device is as follows:<\/p>\n<ol>\n<li>The SelfPay Now application is downloaded from mobile application stores, such as Google Play Store, Apple AppStore and Huawei App Gallery;<\/li>\n<li>It is necessary to register with your e-mail address which will be subsequently validated by a dynamic code, sent to the declared e-mail address, a code that must be entered in the Application to continue the registration flow. If you close the Application, the enrolment flow must be resumed.<\/li>\n<li>To register, it is necessary to enter the following data: name and surname and e-mail address. Later, you will need to enter your phone number. The phone number must not be associated with any other account associated with the SelfPay Now Application. The phone number will be validated by generating a dynamic code that will be sent via SMS. If you close the Application, the phone number association flow must be resumed.<\/li>\n<li>In order to access the Cash2Card and P2P Services and for certain additional services, it is necessary to successfully complete the remote identification process by video means available in the Application.<\/li>\n<li>In order to use the services, it is necessary to enter data about the cards you have in the secure page displayed by the Bank, as well as the home address.<\/li>\n<li>It is necessary to set a PIN immediately after registering the first card for the security of the Application. If you close the Application, the PIN setting flow must be resumed. After that, you can enable biometric authentication and\/or push notification depending on the capabilities of your phone. When activating the biometric authentication, it is necessary to validate the authentication with the biometric factor that is already registered at the level of the device. We inform you that the PIN and biometric information are only stored on your device and such data are not stored on SelfPay or Bank servers.<\/li>\n<li>In order to use the SelfPay Now Application, it is necessary to insert the name, surname, e-mail address, home address and telephone number. Additionally, optionally, you can insert: the date of birth and gender.<\/li>\n<\/ol>\n<p>The user undertakes the obligation to inform SelfPay, as soon as possible, about the modification \/ updating of personal data (e.g., name, e-mail address or telephone number) and identity documents with which the registration has been made. Thus, you can make any changes or updates to personal data directly from the user account, by accessing the section <strong>Menu&gt; Profile&gt; Edit<\/strong>.<\/p>\n<p>You can thus modify the mandatory personal data at any time and\/or insert\/delete optional personal data.<\/p>\n<p>Your personal data will be automatically verified by the Bank in order to know the clientele and prevent the risk of money laundering and terrorist financing in: (i) the lists administered by the Office for the Supervision of Foreign Assets (OFAC), including, but not limited to, the list of Specially Designated and Blocked National Persons; (ii) lists of European Union (EU) sanctions; (iii) the United Nations (UN) sanctions lists; (iv) PAN blacklist; (v) BIN blacklist.<\/p>\n<p>You must register your card following the instructions provided in the Application. You should not attempt to register a card that is not issued on your name and\/or does not belong to you and\/or without complying with the contractual provisions regarding the use of the card agreed with the financial institution\u00a0 issuing the card<\/p>\n<p>You must not attempt to create an account with an identity document, a phone number or e-mail address that do not belong to you and \/or are &#8220;disposable&#8221; \/&#8221;burner&#8221;.<\/p>\n<p>You must not apply for more than one user account. Each user has the right to hold only one user account in the Application. Any repeated or abusive attempt to create multiple user accounts in the Application reserves the right to suspend, restrict or terminate access to the Application and the provision of the Services.<\/p>\n<p>You undertake the responsibility and will not provide false, inaccurate, incomplete or confusing documents and\/or information at any time.<\/p>\n<p>You will not be able to use the\u00a0 Services, until you provide the information requested in accordance with these Terms of Use and\/or the Bank&#8217;s internal terms and policies and if you do not register at least one valid card.<\/p>\n<p>Please note that we will review your registration process as soon as possible. It is at the exclusive discretion of the Bank if it will register and accept you as one of its clients in order to use the services provided by the Bank. If your registration is approved, you will be notified as soon as possible.<\/p>\n<p>A user can download his data by pressing &#8220;Download my account data&#8221; from the\u201d My Account\u201d section.<\/p>\n<ol start=\"5\">\n<li><strong>Use of the Application and the Services <\/strong><\/li>\n<\/ol>\n<p><strong>5.1 Functionality. Additional Information<\/strong><\/p>\n<p>After successful registration and identity verification you will be able to use the Services available through the SelfPay Now Application, depending on the technical availability and monitoring practices of the bank issuing the payer&#8217;s and beneficiary&#8217;s card (and depending on the payment of any applicable fees and compliance with these Terms of Use).<\/p>\n<p>You may use the SelfPay Now Application and the Services only for personal purposes. They will not be used for business-related activities, illegal commercial activities, illegal financial transactions or to create an apparent legality regarding illegally obtained income and\/or for any other transactions carried out in violation of the laws applicable in your country and any other international law. To the extent that, according to the applicable laws, the amounts of money that are the object of the Services used by you, become subject to fiscal obligations, these fiscal obligations and any related procedures always fall under your responsibility.<\/p>\n<p>Periodically, in order to perform the client knowledge procedure (if required by law or banking regulations), you will need to provide some additional documents and information at the Bank&#8217;s request. Otherwise, access to the Services may be restricted.<\/p>\n<p>These documents and information will include, but are not limited to, clear colour photographs or scanned copies of your identity documents, , documents confirming your residence address and any such documents that that are considered necessary.<\/p>\n<p>The Bank reserves the right to request any additional documents and\/or information regarding you, your transactions, and\/or the payer, and\/or the beneficiary of your transfer funds. The Bank will decide, at its own discretion, whether the documents and\/or information provided are sufficient to enable you to use the Services or any part thereof.<\/p>\n<p><strong>5.2 Transaction limits<\/strong><\/p>\n<p>Your transfers may be subject to the limits associated with enrolled cards and the funds available on the card established with\/by the card issuing banks.<\/p>\n<p>The trading limits established by the Bank for the services Cash2Card Transfer and P2 TransferP provided through the Application are the following:<\/p>\n<p>Limits for transferring and receiving funds: maximum 4,000 lei\/month\/card\/user\/account by Cash2Card and maximum 4,000 lei\/month\/card\/user\/account by P2P transfer.\u00a0For the avoidance of doubt, the maximum amount of Cash2Card deposit cumulated with replenishment through P2P transaction is 8000 RON\/month, and the maximum amount of transfer through P2P transaction to another user is 4000 Ron\/month.<\/p>\n<p>The RON 4,000 limits are calculated separately for sending funds (P2P Transfers) and receiving funds (including both P2P Transfers and Cash2Card Transfers), each with a 30-day limit calculation period starting from the date of the first valid transaction, whether it is a transfer or funds receipt transaction.<\/p>\n<p>In the case of cards issued under the Visa logo, the following maximum limits apply:<\/p>\n<ul>\n<li>Maximum 15 transactions per day up to a limit of 2600 RON,<\/li>\n<li>Maximum 25 transactions per week up to 4,000 lei \/ week,<\/li>\n<li>Maximum 75 transactions in a period of 30 days, up to 4,000 lei \/ month.<\/li>\n<\/ul>\n<p>Transaction limits apply for Cash2Card and P2P Transfers. Payments made through the SelfPay Now App either at the Pay Station or in the App are taken in consideration for the Limits calculation.<\/p>\n<p>The minimum amount for each <strong>P2P Transfer<\/strong> transaction is 5 RON. The minimum amount for each <strong>cash deposit is 10 RON<\/strong>, from which the corresponding <strong>transaction fee is deducted<\/strong>.<\/p>\n<p><strong>5.3. Limits on the use of the change vouchers <\/strong><\/p>\n<p>The use of change vouchers (RO: bon de rest) through the SelfPay Now Application is subject to technical limits, established in order to prevent abusive use, prevent fraud and ensure the safe operation of the Cash2Card service.<\/p>\n<p><strong>Limits applicable per user:<\/strong><\/p>\n<ol>\n<li>a) a maximum of <strong>5 (five) change vouchers<\/strong> within a <strong>one-hour<\/strong> interval;<\/li>\n<li>b) a maximum of <strong>15 (fifteen) change vouchers<\/strong> within a <strong>one-day<\/strong><\/li>\n<\/ol>\n<p><strong>Reset of the limits:<\/strong><\/p>\n<ol>\n<li>a) the hourly limit resets at each full hour (i.e., when the next hour begins);<\/li>\n<li>b) the daily limit resets at each calendar day (00:00).<\/li>\n<\/ol>\n<p>When any of these limits is reached, the Application will display an informational message, and the user will no longer be able to carry out additional Cash2Card transactions using change vouchers until the relevant interval (hourly or daily) expires.<\/p>\n<p>These limits may be updated by SelfPay to the extent necessary for protecting users, preventing fraud, managing operational risks, or complying with regulatory requirements. Any changes will be communicated to users through the SelfPay Now Application and\/or by e-mail.<\/p>\n<p><strong>5.4 Permission <\/strong><\/p>\n<p>By using the Services, you authorize the Bank to receive and process transfers or deposits of funds on your behalf and to deduct any applicable Fees from those funds. The initiation of the payment\/deposit orders corresponding to the transfers\/deposits requested by you through the Application is carried out by the Bank.<\/p>\n<p>As regards the P2P Transfers, the Bank will debit the amount of your transfers and any applicable Fees from your card balance at the time of the transaction. As regards the Cash2Card Transfers, the Bank will debit the applicable Commissions from the funds deposited to the SelfPay Payment Stations.<\/p>\n<p>If you make a P2P Transfer or a Cash2Card Transfer, any applicable Fees will be added to the transaction value, so that the total amount of your transaction plus Applicable Fees will be debited from your card or, as the case may be, deducted from the funds deposited at SelfPay Payment Stations.<\/p>\n<p>If you attempt to make a P2P Transfer that exceeds the balance available on your card at the time of your request plus any applicable Fees, then your request will not be processed.<\/p>\n<p>In the unlikely event, for any reason, of a transaction that has been concluded with insufficient funds on your card, the amount due will be refunded by you if it is not due to an error. Where the amount due must be reimbursed by you, you will be asked to immediately deposit the funds on your card to reimburse the negative balance. Until the full amount is fully reimbursed to the Bank, the Bank may suspend your Services. If the Bank considers that the negative balance was intentionally created, this will be treated as potential fraud and will be followed by addressing the control bodies.<\/p>\n<ol start=\"6\">\n<li><strong>Fees and Charges <\/strong><\/li>\n<\/ol>\n<p>The fees and charges (&#8220;<strong>Fees<\/strong>&#8220;) related to the services are specified in the fees section for each P2P Transfer or Cash2Card Transfer. No user fees are applied for P2P Transfer operations. \u00a0For Cash2Card transfer operations, the user is charged a commission of 1.5% of the transaction value, but not less than 5 RON per transaction.<\/p>\n<p>The list of Fees can also be viewed on the website www.selfpay.ro.<\/p>\n<ol start=\"7\">\n<li><strong>Expiration, Termination and Suspension<\/strong><\/li>\n<\/ol>\n<p>(a) Your access to the Services available in the Selfpay Now Application does not expire and will remain valid until terminated by either us or you as set forth in these Terms of Use.<\/p>\n<p>(b) You may close your user account within the Application, with the consequence of terminating these Terms of Use, at any time, by deleting your account directly from the Application. This action is irreversible and if you want to continue using the SelfPay Now mobile the application you must create a new account and go through the same registration steps you originally took. Please note that the personal data, respectively the data related to your transactions, which have reached SelfPay as a result of your use of the Application and the Services will be stored by SelfPay even after you close your account, in order to comply with the storage periods required by applicable law. For more details, please refer to the Information Note on the processing of personal data, available in the Application and at selfpay.ro.<\/p>\n<p>(c) If you delete all cards registered in the Application, you will no longer be able to use our Services. If your registered card(s) expire, you will be asked to register a new card to continue using the Services available in the SelfPay Now Application.<\/p>\n<p>(d) We reserve the right, unilaterally and with immediate effect, to terminate and deny you access to the available Services within the Application in cases related to fraud and\/or suspected fraud and\/or money laundering.<\/p>\n<p>(e) We reserve the right to, at any time, unilaterally suspend and restrict your access to the Application and Services, as well as to terminate of these Terms of Use, with immediate effect or to refuse to reactivate your access, if:<\/p>\n<p>i. you have seriously or repeatedly violated these Terms of Use and if you have not remedied the situation within a reasonable time from the time we notified you to do so (when remediation is possible);<\/p>\n<p>ii. we have reasonable grounds to suspect that you have or may have engaged in fraudulent behavior and\/or if we suspect that your tools\/cards are being used in an unauthorized or fraudulent manner or for illegal purposes (for example but without limiting to the card is not issued in your name and\/or it belongs to a third party); including if we suspect that multiple user accounts belong to the same individual.<\/p>\n<p>iii. you have not provided us with any information we need for the operation of the Services, or if we have reasonable grounds to believe that the information you have provided is incorrect or untrue;<\/p>\n<p>iv. you act in a manner that is threatening or abusive to our staff or to any of our representatives;<\/p>\n<p>v. there are concerns about the security of your cards or if we have reasonable grounds to believe that your use of the Application and Services is harmful to you or to us, our reputation or our software, systems or hardware;<\/p>\n<p>vi. if we have to do so under any law, regulation, court decision or the resolution received from a competent authority.<\/p>\n<p>If possible, we will notify you as soon as possible before doing so, or immediately thereafter, giving you our reasons, if your information does not compromise reasonable security measures or would otherwise be illegal.<\/p>\n<ol start=\"8\">\n<li><strong>Refusal to transfer<\/strong><\/li>\n<\/ol>\n<p>Among other reasons, the processing of a transfer may be denied if:<\/p>\n<p>i. there are not enough funds on your card at the time of the transaction to cover the value of the transaction and any applicable Fees;<\/p>\n<p>ii. you did not deposit sufficient funds at the Payment Station at the time of the Cash2Card transaction to cover the value of the transaction and any applicable Fees;<\/p>\n<p>iii. we have reasonable grounds to believe that you have violated these Terms of Use or the applicable law;<\/p>\n<p>iv. we have reasonable grounds to consider your transfer suspicious or potentially illegal or fraudulent; or<\/p>\n<p>v. there are errors, problems (either technical or otherwise), or refusals from financial institutions issuing cards.<\/p>\n<ol start=\"9\">\n<li><strong>Illegal activity <\/strong><\/li>\n<\/ol>\n<p>You are required to make all reasonable efforts to prevent, or impede the use of the Application and Services for facts or acts of commerce, illegal financial transactions or the legalization of illegal income.<\/p>\n<p>It is forbidden to use the Application and the Services for the purpose of legalizing illegal income, illegal activities, illegal trade, business purposes and any other transactions carried out in violation of the laws applicable in your country and in Europe.<\/p>\n<ol start=\"10\">\n<li><strong>Investigations <\/strong><\/li>\n<\/ol>\n<p>If our investigations show that a transaction reported by you as unauthorized or incorrectly executed was in fact authorized by you, or you acted fraudulently or negligently (for example, without limited to by failing to secure the security features of the card, phone, application), you will be liable for losses incurred as a result of using the Services.<\/p>\n<ol start=\"11\">\n<li><strong>Security <\/strong><\/li>\n<\/ol>\n<p>It is your obligation and responsibility to keep your identification data within the Application confidential and secure, as well as security information and any data related to your card and to never disclose it to anyone.<\/p>\n<p>If another person gains access to your information, application or telephone by passing all security identification and validation checks, we will be entitled to treat any transaction and other transactions made by that person as valid and authorized by you and we will not be able to be held liable for any loss or damage that may be calculated as a result thereof.<\/p>\n<p>All transactions made within the Application are encrypted, and card data will be securely stored and processed through the Bank&#8217;s systems. SelfPay stores only basic information about Cards, respectively: the first 6 and last 4 digits of the card number, the type of card (Visa or Mastercard) and the expiration date. SelfPay does not have access to the security codes of the cards enrolled in the Application. Complete card information is processed only by Romcard.<\/p>\n<p>Contact us immediately if your identification data within the Application are used without your permission.<\/p>\n<p>If you find that a P2P Transfer is not authorized by you, has been processed or has been executed incorrectly or has not been processed, you have the obligation to contact promptly and without delay the issuing bank of your card and us. Any delay in notification may result in your liability for any loss suffered.<\/p>\n<p>We inform you that we are not liable to you if you incorrectly identify the intended beneficiary for a transfer. At the same time, you are responsible for the security of your account and the device on which the Application is installed. In addition, you are responsible for not sharing with anyone, at any time, your account name, password, account card data, and any other data that could lead to unauthorized use of your user account.<\/p>\n<ol start=\"12\">\n<li><strong>Confidentiality and personal data processing <\/strong><\/li>\n<\/ol>\n<p>In order to be able to provide you with the Services and functionalities of the SelfPay Now Application, SelfPay and the Bank need your personal data. You can delete your account at any time, which will terminate the agreement between you and us and make it impossible for you to use the Services available in the Se;fPay Now Application.<\/p>\n<p>To delete personal data related to the user account, you can always access the profile deletion button by following the steps below: &#8220;<strong><em>Meniu&gt; Profile Op\u021bions &gt; My account &gt; Delete the account. <\/em><\/strong><\/p>\n<p>Following the deletion of the user account, the personal data associated with the account will be deleted, and to access the SelfPay services it will be necessary to create a new account. The personal data contained in the documents issued as a result of the provision of the Services will be kept for the periods imposed by the applicable legal provisions.<\/p>\n<p>We are committed to complying with the security and confidentiality of data and we ensure you that all information will be stored securely and treated confidentially. All personal data collected within the Application are processed according to the legal provisions in force and the Information Note on the processing of personal data available, available in the Application and on the website www.SelfPay.ro<\/p>\n<ol start=\"13\">\n<li><strong>Application Updates. New products and services<\/strong><\/li>\n<\/ol>\n<p>We reserve the right to modify change and\/or, as the case may be, remove the content, features, appearance, and\/or structure of the Application according to the technological needs and to improve the Services provided to users at any time and without any prior information. Depending on the type of changes made, you may not be able to access the Services available within the Application until you have downloaded the latest version and accepted the updated terms of use or the additional terms of use if necessary.<\/p>\n<p>Adding a new feature, product, or service within the Application, that does not involve modifying the terms and conditions for P2P Transfer Services and\/or Cash2Card Transfer, we reserve the right to implement these additions immediately without prior notification. Please periodically check the Application to stay informed about such changes. This document will govern all such additions, except where they are governed by additional terms and conditions, in which case you agree that those additional terms and conditions will take precedence in the use of any new features, services, or products.<\/p>\n<ol start=\"14\">\n<li><strong>Additional Services Provided by SelfPay<\/strong><\/li>\n<\/ol>\n<p>Selfpay also provides users of the Application access to services other than those provided above in this document, such as services that allow the payment of utility bills,fees and taxes or the purchase of goods or services from various suppliers with the cards enrolled in the Application. The additional services, their conditions of use and eligibility conditions will be made available and communicated to users through the Application and\/or the SelfPay website. In order to access and use these services, please follow the steps indicated in the Application or at the SelfPay Payment Stations and\/or consult the &#8220;Frequently Asked Questions&#8221; section of our website.<\/p>\n<p>When you access certain services in the SelfPay Now Application (e.g., payment of taxes and related debts) to ensure your identification, you will have to go through and successfully complete the remote identification process by video means available in the Application, a process that involves verifying the identity of the users, based on the identification documents requested and presented,\u00a0 of the captured images and\/or of the information communicated, using video means. For this purpose, we use the services of the remote video identification service provider Onfido and some of its subcontractors. For more details regarding the processing of personal data used for remote identification by video means, please access and consult the document &#8220;Information note on the processing of personal data&#8221; available in the Application and on the website www.selfpay.ro<\/p>\n<p>Cards enrolled in the SelfPay Now App can be used for payment at SelfPay Payment Stations or to pay for the services available in the SelfPay Now App.<\/p>\n<p>At the Payment Station, the payment with the chosen card can be initiated after choosing the option for payment with the SelfPay Now App from the Payment Station screen and scanning the QR code displayed on the Payment Station screen. The transactions for which the authentication is made at the Payment Station with the SelfPay Now App will be displayed in the Transaction History section in the SelfPay Now App, having also the possibility to download the proof of payment.<\/p>\n<p>In the mobile app you can access the Services section, where you can select the services that can be paid for with cards enrolled in the SelfPay Now App. You can identify the provider either by selecting it from a catalog or through the universal identification service made available in the Application. Depending on the provider, you will also be able to make partial payment. Payment details can be found in the Transaction History section.<\/p>\n<p>Some services (for example but not limited to payment of fees and taxes) will require for you to fill in your CNP. You can store your own CNP to benefit from the real-time query and visualization facility. The storage of the CNP can be executed by accessing one of the services that use this data, or by entering it directly in the User Profile.<\/p>\n<p>The proof of payment in the SelfPay Now App will be available for download as a PDF file in the Transaction Details section. For certain services, you will have the option to request the issuance of a tax invoice. If you wish the invoice to be issued in the name of a legal entity, you are required to provide the relevant company details, such as the company\u2019s Unique Identification Code (CUI), Trade Registry registration number, any other necessary information for the issuance of the invoice, as well as the email address to which you would like the invoice to be sent.<\/p>\n<p>Prior to confirming your invoice request, you are obligated to verify and validate the accuracy of the information entered and used within the application. SelfPay does not assume any responsibility for the accuracy or correctness of the data provided by the user within the application.<\/p>\n<p>Minor users with limited exercise capacity (persons who have reached the age of 14 but have not reached the age of 18) may use the Application and the available services only within the limits permitted by the applicable legislation. If certain operations are reserved exclusively for persons who have reached the age of 18 (such as payment transactions for gambling, the purchase of tobacco, alcohol or other specific operations provided for by applicable law), minor users will not access such services, their use being restricted.<\/p>\n<p><strong>14.1. The \u201cVehicle documents\u201d functionality\u00a0 <\/strong><\/p>\n<p>The \u201cVehicle documents\u201d functionality allows you to store your vehicle\u2019s important documents in one place, directly in the <strong>SelfPay Now Application<\/strong> provided by SelfPay S.A. (\u201c<strong>SelfPay<\/strong>\u201d).<\/p>\n<p>This functionality is designed as a simple and convenient way to keep your vehicle documents at hand. It is not a professional archiving service. We recommend that you always keep a backup copy of your documents on your own devices.<\/p>\n<p>You may upload, view, download, and delete, at any time, documents such as: the vehicle identity card, registration certificate, insurance policies, or other useful documents.<\/p>\n<p>The experience may vary depending on the device, operating system version, and User settings.<\/p>\n<p>If you purchase a vignette through the SelfPay Now Application, the officially issued PDF file is automatically saved to the vehicle for which you made the purchase, so that you have it at hand.<\/p>\n<p><strong>a. Responsibility for uploaded documents<\/strong><\/p>\n<p>The documents you upload in the Application belong to you, and you decide how to manage or use them. SelfPay does not verify or validate their content, and the copies stored in the SelfPay Now Application do not replace the original documents.<\/p>\n<p>Please note that SelfPay cannot guarantee the legal or official value of the documents saved in the Application, as this depends on the legislation applicable to each type of document. Even if certain documents may be recognized in electronic format, we recommend that you always keep an original copy or a backup copy outside the Application.<\/p>\n<p>SelfPay cannot be held responsible for the consequences where the User relies on digital copies stored in the SelfPay Now Application and does not hold the original documents. SelfPay does not guarantee that the documents saved or downloaded will be accepted by authorities or third parties.<\/p>\n<p><strong>b. How documents are stored and applicable limits<\/strong><\/p>\n<ul>\n<li><strong>Storage and availability<\/strong><\/li>\n<\/ul>\n<p>SelfPay makes all reasonable efforts to keep documents secure and accessible when you need them.<\/p>\n<p>However, there may be situations where access to documents is temporarily affected or where certain files become unavailable, for example due to technical issues, cyberattacks, maintenance works, or updates to the platforms and the Application, or if the service is interrupted or modified. Therefore, we recommend that you always keep a backup copy of your documents on your own devices.<\/p>\n<ul>\n<li><strong>Technical limitations<\/strong><\/li>\n<\/ul>\n<p>To keep the functionality fast and stable, the following limits are implemented:<\/p>\n<ol>\n<li>maximum number of files per document type: 25;<\/li>\n<li>maximum number of files associated with one vehicle: 100;<\/li>\n<li>maximum size per file: 10 MB;<\/li>\n<li>accepted file types: JPG, PNG, BMP, TIFF, PDF.<\/li>\n<\/ol>\n<p>These limits may be updated periodically. The current accepted values may also be displayed to Users in the Application interface before uploading files.<\/p>\n<p>Some new functionalities may be introduced gradually or may be available only for certain types of documents or devices.<\/p>\n<p><strong>c. Confidentiality and data processing<\/strong><\/p>\n<p>Uploaded documents may contain personal information (e.g., license plate number, addresses, identification data). SelfPay uses them strictly to provide the \u201cVehicle documents\u201d functionality and to allow the User to access the stored documents.<\/p>\n<p>SelfPay does not analyze the content of the documents and does not extract data from them, except in cases where we may introduce, in the future, functionalities such as automatic completion based on OCR (Optical Character Recognition), in which case we will inform you through the Application or by other appropriate means.<\/p>\n<p>User data within the SelfPay Now Application is protected by appropriate technical and organizational measures; however, as with any online service, we cannot guarantee absolute protection against unauthorized access.<\/p>\n<p>Nevertheless, the security of your account also depends on you, therefore we recommend using trusted devices, strong passwords, and not sharing access to your user account.<\/p>\n<p>For details, you may consult our <strong>Privacy policy regarding the protection of personal data <\/strong>available at: <a href=\"https:\/\/www.selfpay.ro\/en\/legal\/selfpay-now\/gdpr\/\">https:\/\/www.selfpay.ro\/en\/legal\/selfpay-now\/gdpr\/<\/a><\/p>\n<p><strong>d. What you are not allowed to upload<\/strong><\/p>\n<p>We want the SelfPay Now Application to remain a safe space for all Users. Therefore, it is not permitted to upload:<\/p>\n<ul>\n<li>false or fraudulent documents or documents that violate legal provisions;<\/li>\n<li>documents that infringe the rights of other persons;<\/li>\n<li>offensive or inappropriate content, or content that may affect the image or reputation of SelfPay.<\/li>\n<\/ul>\n<p>Please upload only documents relevant to your vehicle and do not use the functionality for other types of content.<\/p>\n<p>SelfPay may delete or restrict access to documents that: a) violate the law, our terms and conditions, or third-party rights; b) are morally or ethically inappropriate or may affect the reputation of SelfPay; c) are subject to an official request from an authority.<\/p>\n<p>The User is fully responsible for the legality and authenticity of the uploaded documents.<\/p>\n<p>In order to keep the functionality safe for all Users, SelfPay may limit or temporarily block access to \u201cVehicle documents\u201d if we observe abusive use or use that does not comply with these terms or with the Application\u2019s terms of use. In such cases, we will try to inform you and provide steps to remedy the issue, where possible.<\/p>\n<p><strong>e. Operation and display quality<\/strong><\/p>\n<p>We make every effort to ensure a pleasant and stable experience, however situations may occur where: a) the functionality may experience interruptions, errors, extended loading times, processing failures, or display issues; b) thumbnails, previews, or file conversions may have reduced quality or may be generated incorrectly; c) certain devices or software versions may display content differently.<\/p>\n<p>SelfPay does not guarantee compatibility of the functionality with all devices, operating system versions, or the User\u2019s technical configurations. If you encounter difficulties, our support team is available to assist you.<\/p>\n<p><strong>f. Control over documents<\/strong><\/p>\n<ul>\n<li><strong>User control<\/strong><\/li>\n<\/ul>\n<p>The User has control over the uploaded documents and may, at any time: a) view the documents; b) download them; or c) permanently delete them. Deletion initiated by the User is irreversible. If you delete documents, they can no longer be recovered from the system.<\/p>\n<ul>\n<li><strong>Deletion by SelfPay<\/strong><\/li>\n<\/ul>\n<p>SelfPay will delete the User\u2019s documents in the following situations: a) at the request of the User; b) as a result of a legal provision or a request from a competent authority; c) if the documents violate the law or our terms and conditions; d) if the documents are illegal, non-compliant, morally inappropriate, or affect the image or reputation of SelfPay; e) if maintaining them would breach a legal obligation of SelfPay.<\/p>\n<p>In all other cases, documents remain stored for the duration of the service use.<\/p>\n<p><strong>g. Limitation of liability<\/strong><\/p>\n<p>We aim to provide you with the best possible experience, but there are situations where certain aspects cannot be guaranteed. SelfPay cannot be held liable for: a) loss, corruption, or damage of files; b) unauthorized access beyond our control; c) technical errors or interruptions of the functionality; d) malfunctioning, unavailability, or reduced performance of the functionality; e) incorrect use or interpretation of documents; f) any direct or indirect damages or consequences resulting from the use of the functionality.<\/p>\n<p><strong>h. Automatically saved documents<\/strong><\/p>\n<p>In the case of purchasing a vignette through the SelfPay Now Application, the PDF file issued by the official provider is automatically saved in the Application and attached to the selected vehicle.<\/p>\n<p>The User cannot modify the content of these files. They can only be viewed or deleted.<\/p>\n<p>Automatically generated documents originate exclusively from their official providers. The SelfPay Now Application only displays them for your convenience and does not validate or guarantee their accuracy or validity.<\/p>\n<p><strong>i. Modification. Suspension. Termination<\/strong><\/p>\n<p>SelfPay may update or modify the \u201cVehicle documents\u201d functionality whenever necessary. In such cases, we will inform Users in the Application, either before or at the time the change becomes effective, depending on the nature of the modification.<\/p>\n<p>In certain situations, the functionality may be temporarily suspended without notice, for example in cases of maintenance, technical issues, or security reasons. However, we will strive to restore the functionality as quickly as possible.<\/p>\n<p>If SelfPay decides to permanently terminate the \u201cVehicle documents\u201d functionality, Users will receive prior notice in order to have time to download their stored documents before the service is discontinued.<\/p>\n<p><strong>14. 2. &#8220;<\/strong><strong>Loyalty Cards&#8221; functionality<\/strong><\/p>\n<p>The &#8220;Loyalty Cards&#8221; functionality offered by SelfPay S.A. (&#8220;<strong>SelfPay<\/strong>&#8221; or the &#8220;<strong>Company<\/strong>&#8220;) within the SelfPay Now Application (the &#8220;<strong>Application<\/strong>&#8220;) allows Users to add, organize and display loyalty cards, gift cards, rewards cards or membership cards (&#8220;<strong>Loyalty Cards&#8221;).<\/strong>&#8220;) issued by third-party entities, including any third-party merchant, service provider, or other third-party organization that issues such Loyalty Cards (the &#8220;<strong>Issuer<\/strong>&#8220;).<\/p>\n<p>The Application acts exclusively as a convenient tool for Users, which allows the management of Loyalty Cards issued to them by Card Issuers.<\/p>\n<p>SelfPay does not operate any loyalty program and does not grant, manage, redeem or otherwise administer points, rewards, credits, discounts or other benefits associated with any Loyalty Card stored in the App.<\/p>\n<p>SelfPay has no commercial or other relationship with the Issuers. The issuers are independent third parties, and SelfPay has no authority to act on their behalf or bind them in any way.<\/p>\n<p>The Loyalty Cards added to the Application are entered and managed exclusively by the User. SelfPay does not verify the authenticity or validity of the cards inserted and does not validate the information associated with them.<\/p>\n<p><strong>a. What you can do using the feature<\/strong><\/p>\n<p>The Functionality allows Users to: (a) store information regarding a Loyalty Card saved by a User in the Application, including card numbers, barcodes, QR codes, card image; (b) organize Loyalty Cards using custom categories and labels; (c) access a Card template, which is a pre-configured visual appearance within the Application that displays the visual identity of an Issuer to assist Users in identifying and adding Loyalty Cards to the Application; and (d) display Loyalty Cards stored at the relevant points of sale using barcodes, QR codes or card numbers; (f) share Loyalty Cards with other Users of the Application.<\/p>\n<p>The Card templates are provided for identification and convenience purposes only. They may display a Loyalty Card Issuer&#8217;s name, logo, color scheme, or other visual identifiers. These elements remain the intellectual property of those Issuers. The brands are displayed exclusively for the purpose of allowing Users to identify and organize the Loyalty Cards that have been issued to them directly by the Loyalty Issuers.<\/p>\n<p>SelfPay strives to keep Card templates accurate and up-to-date, but does not guarantee that any template reflects an Issuer&#8217;s current design, branding, or program details. Users are responsible for verifying Loyalty Card data directly with the relevant Issuer.<\/p>\n<p>The App does not interact with, access, or modify any Loyalty Card Issuer&#8217;s loyalty program systems. The App does not retrieve information about balance, point totals, transaction history, or other live data from Issuers, unless a specific integration is expressly made available and disclosed to Users.<\/p>\n<p><strong>b. Availability<\/strong><\/p>\n<p>The &#8220;Loyalty Cards&#8221; functionality is made available to Users in the form available in the Application at the time of use. SelfPay makes reasonable efforts to ensure its availability, but does not guarantee uninterrupted or error-free operation. SelfPay may modify, suspend or discontinue, in whole or in part, the functionality at any time.<\/p>\n<p><strong>c. Responsibility for added cards<\/strong><\/p>\n<p>The User is solely responsible for all data related to the Loyalty Cards (QR code, card number, barcode, image, etc.) and other data or information revealed that you enter, upload or store in the App. The Company does not verify the accuracy, validity or authenticity of the data you provide.<\/p>\n<p>By using the Application, the User represents and warrants that: (a) he\/she is the rightful holder of each Loyalty Card he\/she stores in the Application; (b) all data relating to the Loyalty Cards you enter are correct and refer to a card validly and authentically issued by an Issuer; and (c) the User&#8217;s use of the Application does not violate the terms and conditions of any Loyalty Card Issuer.<\/p>\n<p>The Company is not responsible for any loss of data related to the Loyalty Card stored in the Application, resulting from device failures, errors of the Application, loss of access to the user account or any other cause. You are encouraged to keep independent records of your Loyalty Card details.<\/p>\n<p><strong>d. What is not allowed<\/strong><\/p>\n<p>It is not allowed to use the &#8220;Loyalty Cards&#8221; functionality and related services for:<\/p>\n<ol>\n<li>Entering false, fraudulent, or illegally obtained barcodes or QR codes.<\/li>\n<li>the storage of Loyalty Cards that do not belong to the User or to which you do not have authorized access;<\/li>\n<li>impersonating another person or misrepresenting your identity in relation to a Loyalty Card<\/li>\n<li>Using the Feature in a way that violates the law or the rights of others.<\/li>\n<\/ol>\n<p>SelfPay may limit or restrict access to the functionality or App in the event of misuse or inconsistent with these Terms or the terms of use of the App.<\/p>\n<p><strong>e. Relationship with issuers<\/strong><\/p>\n<p>The SelfPay App is not affiliated with, sponsored by, and is not connected to Issuers whose Loyalty Cards may be stored within the App.<\/p>\n<p>The inclusion of a Card template, logo or name of a Card Issuer within the Application does not imply any partnership, affiliation, endorsement or approval by the respective Card Issuer of the App, SelfPay or these Terms.<\/p>\n<p>The App does not guarantee that a Loyalty Card saved in the App will be accepted at points of sale. Acceptance of a digitally stored Loyalty Card is at the sole discretion of the relevant Card Issuer and\/or its staff.<\/p>\n<p>SelfPay is not an authorized representative, reseller, agent, partner, or franchisee of any Issuer. Any communication, complaint or dispute relating to Loyalty Cards should be addressed directly to the relevant Issuer. SelfPay may not intervene, mediate or resolve disputes between Users and Card Issuers.<\/p>\n<p>The terms, conditions, benefits, points balance, expiration rules and policies applicable to any Loyalty Card are governed solely by the agreement between the User and the relevant Issuer. SelfPay is not a party to this agreement, and nothing in these Terms modifies or replaces it.<\/p>\n<p>SelfPay is not responsible for, and has no control over: (a) any changes that a Card Issuer makes to its loyalty program, including the closure, modification or devaluation of points; (b) the decision of a Loyalty Card Issuer to refuse to accept a digitally presented Loyalty Card; (c) any loss of points, rewards, benefits or rights arising from the use or non-use of a Loyalty Card; or (d) any act or omission of a Card Issuer in connection with a loyalty program.<\/p>\n<p><strong>f. Share of Loyalty cards<\/strong><\/p>\n<p>The functionality allows the User to share a Loyalty Card stored in the Application with other Users of the Application, via a sharing link generated by the Application.<\/p>\n<p>The sharing mechanism works as follows:<\/p>\n<ul>\n<li>The source user who initiates the sharing clicks on the share button associated with a Loyalty Card and generates a sharing link, which he can send through any communication channel of his choice (e.g. WhatsApp, email, Messenger, etc.).<\/li>\n<li>The sharing link is valid for 7 (seven) calendar days from the generation or until a number of 50 (fifty) cards are added through the same link, whichever occurs first.<\/li>\n<li>The user who accesses the sharing link is informed, before acceptance, that a copy of the loyalty card for the specified loyalty program is to be added to the Application. The user can accept or decline the addition.<\/li>\n<li>In case of acceptance, the Recipient User receives a copy of the Loyalty Card in read-only mode. This copy cannot be modified by the Recipient User; He can only view it or delete the card from his own account.<\/li>\n<li>The copy of the Loyalty Card created by sharing is independent of the original card in the Source User&#8217;s account. The Recipient User&#8217;s actions do not affect the original card.<\/li>\n<\/ul>\n<p>The source user is solely and exclusively responsible for the decision to share a Loyalty Card, for the choice of recipients and for any consequences arising from this action. By initiating sharing, the Source User represents and warrants that:<\/p>\n<ul>\n<li>has the right to share the Loyalty Card in accordance with applicable law and\/or the terms and conditions of the relevant issuer;<\/li>\n<li>understands that by sharing the card, another person will be able to use the card&#8217;s information (including barcode, QR code, or card number) to present the card at the Issuer&#8217;s points of sale;<\/li>\n<li>fully accepts the risk and responsibility for any use of the Loyalty Card by the Recipient User, including, without limitation, the consumption of points, rewards or other benefits, unauthorized use of the Issuer, or any other consequence derived from the sharing of the card.<\/li>\n<\/ul>\n<p>SelfPay is not responsible for any loss of points, rewards or benefits, for any unauthorized use of a shared Loyalty Card or for any other consequence resulting from the use of the sharing functionality by the User.<\/p>\n<p>The source user is encouraged to check in advance whether the Issuer&#8217;s terms and conditions allow for the sharing or multiple use of a Loyalty Card. SelfPay is not aware of and does not check these terms for each Issuer.<\/p>\n<p><strong>g. Modification. Suspension. Termination<\/strong><\/p>\n<p>SelfPay may update or change functionality whenever necessary. In such situations, we will inform Users in the Application, either before or at the time the change becomes effective, depending on the nature of the change.<\/p>\n<p>In certain situations, the functionality may be temporarily suspended without notice, for example in case of maintenance, technical problems or security reasons. However, we will strive to restore functionality as quickly as possible.<\/p>\n<p>If SelfPay decides to permanently terminate the functionality, Users will receive prior notice.<\/p>\n<p><strong>\u00a014. 3. <\/strong><strong>Sharing functionality. General Rules<\/strong><\/p>\n<p>Certain functionalities of the Application allow the User to generate and distribute sharing links (&#8220;<strong>Share Links<\/strong>&#8220;) through which content from his\/her account (loyalty cards, car documents, other documents or elements available in the Application) can be accessed or copied by other people.<\/p>\n<p>By using any sharing functionality available in the Application, the User declares and accepts that:<\/p>\n<ul>\n<li>is solely responsible for the decision to share, the choice of recipients, and any consequences arising from the sharing of a Sharing Link;<\/li>\n<li>SelfPay does not control and cannot limit the spread of a Sharing Link once transmitted by the User on channels external to the Application (messaging, email, social networks, etc.);<\/li>\n<li>SelfPay is not responsible for any unauthorized, fraudulent or harmful use of the shared content, carried out by persons to whom the User has transmitted, directly or indirectly, a Sharing Link;<\/li>\n<li>The User ensures that the sharing of content does not violate the rights of third parties, other users or any other persons, applicable legislation or the specific terms and conditions of the functionality used.<\/li>\n<\/ul>\n<p>SelfPay may suspend or revoke the sharing functionality, in whole or in part, at any time without prior notice, in particular in the case of misuse or fraudulent purposes.<\/p>\n<ol start=\"15\">\n<li><strong>Intellectual Property<\/strong><\/li>\n<\/ol>\n<p>The content of the Application is protected by intellectual property law, including, without limitation, copyright law. All rights related to the information provided on or through the Application are the property of SelfPay. These include, without limitation: data, texts, technical sources of web pages, news, graphics, drawings, photographs, illustrations, images, logos, services, APIs and any other mentions. The content of the Application may not be reproduced, copied, translated or modified in any way, in whole or in part, without our prior written permission.<\/p>\n<p>We may grant a limited, revocable and non-exclusive license to create a hyperlink to the main page of the Application, as long as this link does not describe in a false, wrong or offensive way SelfPay, the Bank, our partners or our affiliates. The license granted for the hyperlink does not allow you to use our trademarks without our prior written consent.<\/p>\n<p>All intellectual property rights (including, without limitation, copyright and rights in the source code and databases) regarding the trademark, trademarks, logos and all materials in the Application are our property or used by us under a license or with permission of our partners, including the Bank.<\/p>\n<p>Nothing in the Application shall be construed as implicitly or otherwise granting any license or right to use any trademark displayed in the Application without our written permission or that of our partners, including the Bank, who may own the trademark.<\/p>\n<p>In case of violation of these terms, we can take, for the recovery of damages, SelfPay will resort to any and all necessary and applicable legal means, and for our protection, we can block the access of any user within the Application<\/p>\n<ol start=\"16\">\n<li><strong>Modifications<\/strong><\/li>\n<\/ol>\n<p>Periodically, these Terms of Use may be subject to change. In such a situation, you will be notified at least 14 days in advance of the date on which the changes will take effect, by e-mail to the address indicated by you when you created your account. SelfPay SA can also use other communication methods in its relationship with you, such as SMS, push notifications or in-app notifications. This term will not apply to contractual changes imposed by the application of new legal provisions, such changes being applied depending on the date of entry into force of the respective regulations.<\/p>\n<p>In case of an increase in any Charges or the introduction of new charges, the notification will be sent at least 60 days before the date on which the changes will take effect.<\/p>\n<p>If we add a new product or service, we may add the product or service immediately and notify you of the terms and conditions of use before using it.<\/p>\n<p>After the date of entry into force of any changes to the Terms of Use, the absence of a refusal made by you and the continued use of the Application and the Services will constitute your acceptance of such amendments.<\/p>\n<p>If you do not agree with the notified changes, you will be able to inform us in this regard during the time periods until the entry into force of the notified changes. We will treat your communication as a notice of termination of these Terms of Use. In these circumstances, we will restrict your access to the Application and related Services.<\/p>\n<ol start=\"17\">\n<li><strong>Limitation of liability<\/strong><\/li>\n<\/ol>\n<p>We are not liable for any loss or damage suffered by you, caused by the causes specified below:<\/p>\n<p>(i) if you are unable to access the Application and\/or Services at any time due to interruptions or malfunctions or delays in telecommunications services, internet or power supply, which we use through our external suppliers with which we have contracted these services or, when the latter are due to a fortuitous event or force majeure event;<\/p>\n<p>(ii) the temporary impossibility of using the Application and\/or the Services during the maintenance periods (technical revision, including their improvements);<\/p>\n<p>(iii) if you cannot access at any time the Application and\/or the Services or their corresponding malfunction, due to the equipment \/ devices \/ computer programs, etc. used by you;<\/p>\n<p>(iv) in case of improper use of the Application and\/or the Services, including in case of erroneous data transmission;<\/p>\n<p>(v) when, through the negligence of the user, the identification elements come to the knowledge of other persons;<\/p>\n<p>(vi) the computer system\/device belonging to the user has been accessed by unauthorized third parties or has been hacked;<\/p>\n<p>(vii) if the user discloses the identification\/access elements in the Application as a result of phishing attacks or computer viruses on his equipment\/devices. The liability to the user is limited to the direct damages suffered by him, which are a direct and necessary consequence of the non-execution of our obligations, in accordance with the legal provisions and\/or those provided in these Terms of Use.<\/p>\n<p>(viii) we have no liability to the User in respect of the requirements\/conditions and\/or any limitations\/restrictions (and\/or any violations by the User of such requirements\/conditions\/limitations\/restrictions) regarding the use of the cards enrolled in the Application established by the financial institution issuing the Card.<\/p>\n<ol start=\"18\">\n<li><strong>Miscellaneous <\/strong><\/li>\n<\/ol>\n<p>These Terms of Use are personal to you and you may not assign or otherwise transfer your rights and obligations therein. We may assign or transfer the benefits or obligations of these Terms of Use to another entity at any time, with reasonable notice in advance. If we do so, your rights will not be affected.<\/p>\n<p>These Terms of Use will be governed by the laws of Romania. During the support session, you may navigate within the application in order to perform the necessary operations, while simultaneously receiving real-time assistance from SelfPay representatives.<\/p>\n<p>The communication with you will take place via e-mail at the address indicated by you when you created your account. SelfPay SA can also use other communication methods in its relationship with you, such as SMS, push notifications, or in-app notifications.<\/p>\n<p>Any comments, questions, feedback, ideas, suggestions or other communications or information about or related to the SelfPay Now application, its functionality or improvement will remain the property of SelfPay SA.<\/p>\n<p>Any user of the Application can address complaints to SelfPay SA as soon as he\/she becomes aware of the disputed event, indicating the problem encountered and additional information necessary to identify the transaction, the phone number where he\/she can be contacted and the address he\/she wants to receive in writing the response to his complaint. SelfPay will send the user the reasoned response to the complaint, within a maximum of 10 business days from the date of receipt of his\/her complaint.\u00a0<\/p>\n<p>For complaints that require complex investigations, the previously mentioned deadlines required by SelfPay to formulate the response to the user&#8217;s complaint may be extended.
