THE PROCESSING OF PERSONAL DATA BY <\/strong>SELFPAY SA THROUGH SELFPAY PAYMENT STATIONS<\/strong><\/h3>\n

In order to be able to provide the services and functionalities of the SelfPay Payment Station<\/strong>, SelfPay SA, a Romanian company with a legal entity status, headquartered in Bucharest, 153-155 Dacia Blvd., 7th floor, 2nd district, registered with the Trade Register under no. J40\/9919\/2009, CUI RO26067497, will collect, either directly from you, or indirectly from our partners, based on your consent given at the time of processing, and will process personal data.<\/p>\n

Please read carefully and be informed about the personal data that is collected and processed through the SelfPay Payment Station in order to be able to offer the services described in the Terms and Conditions of use of the SelfPay Payment Station<\/strong>. <\/em><\/p>\n

All personal data collected through the SelfPay Payment Station<\/strong> are processed according to the legal provisions in force and this Information Note. The purpose of this document is to inform you about the personal data that are collected from you or in connection with you, the way in which these data will be processed, as well as the rights you have in connection with the processing activities.<\/p>\n

Please note that according to SelfPay’s internal policy, the use of the SelfPay Payment Station is prohibited for persons under the age of 18.<\/strong><\/p>\n

Thus, it will be necessary that, when accessing the SelfPay Payment Station or some services offered by our partners, you confirm that you meet the minimum age requirement mentioned above<\/strong>. We would like to inform you that any misrepresentation on observing the age requirement is a violation of the terms and conditions of use of the SelfPay Payment Station<\/strong> and the services of our partners.<\/p>\n

PURPOSES AND CATEGORIES OF PERSONAL DATA COLLECTED AND PROCESSED THROUGH SELFPAY PAYMENT STATIONS<\/u><\/strong>.<\/h5>\n

Please find below, in detail, the purposes and categories of data that are collected and processed through the SelfPay Payment Station<\/strong>:<\/p>\n

  1. Provision of specific services by SelfPay partners.<\/strong><\/li>\n<\/ol>\n

    SelfPay Partners use SelfPay Payment Stations<\/strong> to provide their own services. Find the full list of services offered by SelfPay partners on the website www.selfpay.ro<\/p>\n

    In order to provide these services, SelfPay partners collect from you, through the SelfPay Payment Stations<\/strong>, personal data, such as: name and surname, address, email address, PIN, telephone number, identification codes from utility bills, the information contained in the barcode on an invoice, registration number, chassis series, unique service code, e-wallet address, age, etc.<\/p>\n

    The list presented above of personal data collected by SelfPay partners through SelfPay Payment Stations<\/strong> is indicative and differs depending on the service employed by each individual payer.<\/p>\n

    Please note that the use of the SelfPay Payment Station<\/strong> is a self-service<\/strong> and does not require registration or the opening of a user account<\/strong>. Thus, the transactions carried out at the SelfPay Payment Stations are independent of each other<\/strong>, not being structurally linked to each other by common key elements. For this reason, each individual transaction carried out through SelfPay Payment Stations requires the collection of all the data necessary for its execution, according to the specifications received from each individual partner.<\/p>\n

    Personal data is provided directly by you through the SelfPay Payment Station screens. The collection and processing of your personal data by SelfPay partners through the SelfPay Payment Station is based on your consent. During the transaction, you can always opt out of providing your personal data in order to complete a service provided by SelfPay partners, this is equivalent to not giving your consent to the processing of personal data for the purpose of performing the chosen service. Failure to grant your consent in this way leads to the impossibility of completing the transaction and providing the service in question.<\/p>\n

    Please note that, once granted, by accepting the completion of a transaction, your consent to the processing of personal data already provided for the execution of the transaction cannot be withdrawn.<\/p>\n

    1. Collection of personal data by SelfPay. <\/strong><\/li>\n<\/ol>\n

      In the case of SelfPay partners’ services provided through SelfPay Payment Stations and which require the SelfPay Payment Station to issue a receipt\/voucher slip, SelfPay collects and processes the following personal data from the users of these services: e-mail address (e – email).<\/p>\n

      The e-mail of the users of these services is collected by SelfPay in order to provide an alternative channel for sending the receipt\/voucher slip in case they cannot be physically issued due to error or malfunction of the SelfPay Payment Station. The e-mail thus collected is not used by SelfPay for any operational purpose other than that mentioned above, not for marketing or promotional purposes.<\/p>\n

      In the case of SelfPay partner services that offer you the possibility to manually introduce the data mentioned in point 1 above, SelfPay will collect your mobile phone number. The mobile phone number collected in this way will be used by SelfPay exclusively for contacting you if you have erroneously entered the necessary data to finalize a payment through the Payment Station. Since, due to the entry error, the payment was refused by the Partner and the sum of money returned to SelfPay, it is necessary for SelfPay to be able to contact you in order to refund the owed sum of money.<\/p>\n

      In the application of SelfPay’s legitimate interest in demonstrating the provision of contractual services to its partners and compliance with the contractual clauses concluded with them, any personal data found in the content of transactions that users of SelfPay Payment Stations carry out together with SelfPay’s partners will be stored, as an integral part of the transactions, for a period of 5 years from the completion of each individual transaction.<\/p>\n

      Also, the data thus stored in transactions as well as the personal data belonging to a user of the SelfPay Payment Stations, included in the correspondence carried out by SelfPay with that user, may be used by SelfPay, in its legitimate interest, for ascertaining, the exercise or defence of a right in court (for example, they will not be deleted if there is an ongoing dispute between SelfPay and the respective user or the initiation of a dispute is imminent).<\/p>\n

      TO WHOM YOUR PERSONAL DATA WILL BE DISCLOSED<\/u><\/strong><\/h5>\n

      The personal data collected through the SelfPay Payment Stations for each type of service will be transmitted only to the SelfPay partner that provides that service and, to the extent that they request, to the authorities that are legally entitled\/authorized to take possession of these data.<\/p>\n

      Personal data is disclosed only to authorized persons, according to the technical and organizational procedures undertaken and established by SelfPay to preserve the confidentiality of personal data, to protect against accidental or unlawful destruction, loss, disclosure or unauthorized access, in accordance with the law.<\/p>\n

      FOR HOW LONG YOUR PERSONAL DATA COLLECTED AND PROCESSED THROUGH SELFPAY PAYMENT STATIONS ARE KEPT<\/u><\/strong><\/h5>\n

      SECURITY OF PERSONAL DATA COLLECTED AND PROCESSED THROUGH SELFPAY PAYMENT STATIONS<\/u><\/strong><\/h5>\n

      SelfPay is committed to observing the security and confidentiality of personal data and ensures that all information collected by its partners through SelfPay Payment Stations will be stored and processed under safe conditions and will be treated confidentially.<\/p>\n

      RIGHTS OF USERS OF SELFPAY PAYMENT STATIONS REGARDING THE PROCESSING OF THEIR PERSONAL DATA<\/u><\/strong><\/h5>\n

      In relation to the processing of personal data, users of SelfPay Payment Stations benefit from the following rights:<\/p>\n

      1. The right to information <\/strong>\u2013 means that you have the right to receive information regarding the personal data processing activities carried out through the SelfPay Payment Stations;<\/li>\n
      2. The right of access \u2013 <\/strong>means that you have the right to obtain a confirmation regarding the processing or not of your personal data through the SelfPay Payment Stations, as well as information regarding how these data are processed;<\/li>\n
      3. The right to rectification <\/strong>\u2013 means that you have the right to ask us to correct it when your data in our possession and processed by us is incomplete, inaccurate or has changed since the date of collection. Please note that this right does not apply to the data of transactions completed by you at SelfPay Payment Stations;<\/li>\n
      4. The right to delete data<\/strong> – means that you have the right to ask us to delete your personal data if it is no longer necessary for us to keep or use them or when you want to withdraw the consent you previously gave to the processing of some data, if the data has been processed illegally or if you consider that the legitimate interest of processing your personal data is not justified;<\/li>\n
      5. The right to restrict processing<\/strong> \u2013 means that you have the right to ask us to restrict the processing of your data when you consider that it is inaccurate, you consider that the processing of your data is not legal, you want us to keep your personal data beyond the minimum required retention period, as well as during the exercise of your right to object to processing when you consider the legitimate interest considered by SelfPay to be unjustified. Please note that this right does not apply to the processing of transactions completed by you at SelfPay Payment Stations<\/li>\n
      6. The right to object<\/strong> \u2013 means that you have the right to object to the processing of data based on the legitimate interest of SelfPay when you consider that this processing will harm your interests, rights and freedoms or when the processing of your data is aimed at direct marketing;<\/li>\n
      7. The right to data portability<\/strong> \u2013 means that you have the right to receive the data collected by us from you and processed automatically, following your consent or following contractual provisions, in a structured format that is easy to use or to transmit your data to another operator of personal data, if this is technically possible;<\/li>\n
      8. Rights related to the automated individual decision used in the process of providing products and services<\/strong> \u2013 means that you have the right not to be the subject of a decision based exclusively on automatic processing without human intervention, including the creation of profiles, and which produce effects regarding your interests, rights and freedoms.<\/li>\n
      9. The right to withdraw consent<\/strong> – if the processing is based on consent, it can be withdrawn at any time. The withdrawal of consent will have effects for the future, the processing prior to the withdrawal remaining valid.<\/li>\n
      10. The right to file a complaint<\/strong> – the data subject may file a complaint against the manner of data processing by SelfPay and\/or its partners to the National Authority for the Supervision of Personal Data Processing;<\/li>\n<\/ol>\n
