#### **TERMS AND CONDITIONS OF USE OF THE SELFPAY PAYMENT STATION AND SELFPAY MOBILE APPLICATION FOR CUSTOMERS**
The information below informs you of the general conditions for concluding transactions through SelfPay Payment Stations or on other payment terminals and/or applications or software solutions on which the “SELFPAY” application operates for the products and services offered by Salt Bank. For clarity, “SELFPAY” has the right to offer SALT BANK Customers any other channel for paying amounts of money (payment of credit instalments, payment of the equivalent value of invoices, fines, etc.), the channel shall be understood to include the SelfpayNow mobile application.
In the case of using the “SELFPAY” application for paying credit instalments to Salt Bank, utility bills, taxes and/or duties, the Customer’s obligations towards Salt Bank are considered honoured from the moment of inserting the banknotes at the Payment Station, within the limits of the amounts paid and under the condition of correctly entering the identification data of the obligation paid. It is mandatory to keep the receipt, which confirms the payment.

Below we present the contractual and technical conditions for carrying out transactions through SelfPay Payment Stations and through any other digital payment channel (mobile application SelfPay Now
**I. GENERAL PROVISIONS**
1.1 This document represents a public offer (hereinafter referred to as the “Offer”) in accordance with the regulations of the Romanian Civil Code.
1.2 The executor of this offer is:

1.3 The Offer contains the contractual conditions regarding the provision of services for:
– the collection of credit instalments for loans granted by Salt Bank
– the collection of taxes and duties to local public authorities/public institutions mentioned in the Payment Station interface and/or other digital channel (mobile application “SelfpayNow”, etc.), their payments being ordered by the Customer directly, immediately, to SALT Bank;
– the payment of invoices issued by user providers, through the Payment Station or through the “SelfPayNow” application, for the services/products of the providers mentioned in the Payment Station interface, and expresses Salt Bank’s desire to conclude a contract under the conditions formulated in the offer with any person who accepts the indicated conditions (hereinafter referred to as the “Customer”).
1.4 The services provided to the Customer through the Payment Station or through the “SelfpayNow” application by the SelfPay Intermediary (hereinafter referred to as the “Services”) are:
– Provisional use of the Payment Station and/or the “SelfPayNow” application to the Customer, for entering information regarding:
– the payment of credit instalments for loans granted by Salt Bank
– the payment of taxes and duties to local public authorities/public institutions mentioned in the Payment Station interface, the payment to be made at the request/order of the Customer directly to the banking unit/Salt Bank, which in turn transfers the amounts to the beneficiary institutions;
– Offering the Customer the possibility of making payments to the benefit of any provider on the list, indicated in the Payment Station interface and which can either be continued at the SelfpayNow Application level, or can be initiated in turn from the application;
– Ensuring the electronic connections necessary for the transmission of payment data to SaltBank / Supplier / Public Authority, based on the identifier entered by the Customer (phone number, account number, contract number or other types of information indicated on the corresponding page regarding the execution of the transaction desired by the Customer, in the Payment Station interface) and which can also be carried out/continued at the level of the “SelfpayNow” mobile application;
– Ensuring the transmission of payment information to Salt Bank / Supplier / Public Authority within the deadlines, conditioned by the technical possibilities of the Payment Station and used by the executor of external data transmission networks (the deadline for data transmission for the benefit of some suppliers may be at least 48 hours, and this information is indicated on the corresponding page for the execution of the transaction in the Payment Station interface).
**II. MAKING THE TRANSACTION **
2.1 The Customer’s action of using the SelfPay Payment Station and/or the “SelfPay” application to transmit to Salt Bank the data for making payments to Salt Bank, Suppliers/Beneficiaries and to Local Public Authorities, based on the elements indicated by the Customer, is interpreted as a full and irrevocable acceptance of these Terms and Conditions of Use of the SelfPay Payment Station and/or the “SelfPay” application. The transmission of data for making payments through the SelfPay Payment Station and/or the “SelfPay” application represents a transaction, executed under the conditions indicated in the offer. The offer is considered fully and irrevocably accepted and the transaction with the Supplier is considered concluded at the time of issuing the receipt by the Payment Station.
2.2 The Customer is obliged to study and comply with the instructions for using the Payment Station, which can be accessed from its interface (Instructions). Actions taken by the Customer, not provided for by the instructions, do not constitute a basis for SelfPay to assume obligations for the provision of Services. In case of disagreement with the requirements of the contract or misunderstanding of the provisions of the instructions. The Customer is not entitled to use the Payment Station to undertake other actions, whether provided for or not provided for by the instructions.
2.3 The Customer is obliged to keep the receipt issued by the Payment Station regarding the provision of Services until receiving information from the Provider regarding the replenishment of the account.
2.4. When making payments, the Customer is asked to insert the corresponding amount in cash into the Payment Station, since the device does not have the technical ability to give change by design.
If the Customer has entered an amount greater than the price of the desired product/service, he/she has the option of either using the barcode representing the remainder and which is located on the receipt issued by the Payment Station to make a subsequent payment through the Payment Station, equal in value to the remainder, or requesting its transfer to a bank account, opened at a bank in Romania. The Customer declares, by accepting these terms and conditions of use of the SelfPay Payment Station, that he/she waives his/her right to request the remainder after a period of 6 months has passed from the date of the transaction that generated it. **III. PRICE OF SERVICES**
3.1. In this case, the Bank, through the Payment Station and/or the “SelfPay” application, informs the Customer about the Price of the Services until the payment is made (information about the price of the services is indicated on the page corresponding to the transaction on the Payment Station interface as well as in the General List of tariffs, interests and commissions_individuals located on the Salt Bank website). The Customer has the right to refuse the Service at any time until the money/card is inserted into the banknote receiver of the Payment Station.
3.2 Payment for the Services is made by withholding the price of the Services by the SelfPay Payment Station from the amount entered by the Customer at the Payment Station.
3.3 The moment of the transaction is confirmed by a corresponding document (receipt issued by the Payment Station).
**IV. OTHER CONDITIONS**
4.1 SelfPay and Salt Bank have the right to temporarily suspend the provision of Services in the event that there is no technological possibility of interaction between suppliers and Customers.
4.2 SelfPay and Salt Bank are not liable for direct or indirect damages incurred by the Customer as a result of using the Payment Station and/or the “Selfpay” application. SelfPay and Salt Bank are not liable for interruptions in the provision of Services in the event of software failure or the execution of other works necessary to maintain the operating capacity or to upgrade the program and/or the Payment Station.
4.3 The Customer has the right to submit written claims to SelfPay regarding the quality and terms of provision of Services, no later than three days from the date of receipt. The term for examining the Customer’s claims must not exceed ten calendar days. The Customer shall also address to Salt Bank any complaint or request for information regarding the transaction.
4.4 The Customer has the right conferred by the legal provisions to address:

4.5. The amounts paid for the payment of credit instalments to SaltBank will be blocked in the account exclusively for this purpose until their due date. SelfPay and SaltBank are exempted from any liability as a result of the Customer incorrectly entering the data necessary for the payment of the credit instalment. In the event of such unwanted situations, SaltBank offers support for resolving problems at \*4455 (021.318.95.00).
4.6. The actual payment of the debt to the selected utility provider does not coincide with the deposit of the amount at this Payment Station, the transmission of the amounts deposited at the SelfPay Payment Station occurring within a maximum of 4 business days, at the time of the actual transmission of the amounts to the provider. SelfPay and SaltBank are exempt from any liability as a result of the customer incorrectly entering the data necessary for the payment or as a result of the utility provider’s refusal to collect the payments. In the event of such undesirable situations, SaltBank offers support for solving the problems that have arisen at \*4455 (021.318.95.00).
4.7 The amounts collected by SALT Bank representing the equivalent of taxes and fees will be transferred/deposited to the territorial administrative units/public institutions within a maximum of 1 day from the date of the successful payment at the Payment Station level. The Customer is responsible for correctly selecting the nature of the payment amount (e.g. tax, fine), depending on the type of service concerned, and for carefully entering the data necessary to recognize the payment and the payer (e.g. PIN, Customer code, report number, document number, etc.), according to the information displayed in the Payment Station interface or the SelfPay Now mobile application, before confirming and making the transaction.
4.8. The terms and conditions of the services may be modified by Salt Bank and SelfPay and shall be brought to the attention of the Customer until the moment of providing the Services and making the payments to the suppliers, which include the price for the provision of the Services.
4.9. In order to improve the quality of the services provided by SelfPay, as well as to be aware of our offers, continuing the transaction automatically expresses your consent to the use of your personal data for the purpose of sending commercial communications.
**V. INFORMATION NOTE ON PERSONAL DATA PROTECTION**
5.1 Considering the functionality of the “SelfPay” software application which involves the transmission by the Customer/user of personal data to SelfPay S.A. and Salt Bank, in order to carry out the operation chosen by him/her, the user/subject understands and agrees to mention the necessary identification data at the time of choosing the service. In relation to the chosen operation, certain personal data may be provided: name and surname, Customer code, invoice number and date, etc.
5.2 The owner of the application as well as the partner Salt Bank request personal data in order to correctly identify the issues raised by the Customer/user and to follow up on the request and the operation chosen by him/her, as follows:
a. to carry out payment operations, personal data is requested consisting of: name and surname, telephone number, email address, ID number, invoice number and date, etc.;
b. to carry out marketing activities, by using electronic mail (email, SMS), which may take the form of Newsletters and/or periodic alerts, “push” notifications made by SelfPay, SaltBank or the authorized marketing agency;
Personal data is disclosed only to authorized persons, according to the technical and organizational procedures assumed and established by the owner of the “SelfPay” application, these being adequate and necessary to maintain the confidentiality of personal data, to protect against accidental or illegal destruction, loss, disclosure or unauthorized access, according to the law.
**VI. PROCESSING OF PERSONAL DATA**
6.1 The owner of the “SelfPay” application is a Romanian company with legal personality, having the obligation, according to the provisions of the EU Regulation 679/2016, to manage in safe conditions and only for the specified purposes, the personal data that the user provides. In accordance with the provisions of the Civil Code regarding the legal institution of prescription, the collected personal data are archived/stored by the owner of the application for a period of 3 years.
6.2 The Customer/User, by transmitting personal data, declares and unconditionally accepts that his personal data be part of, and be archived in the owner’s database, thus expressing an express and unequivocal agreement that his/her personal data be stored, used and processed according to the purposes mentioned above.
6.3 The Customer/User declares by checking the box “I agree to the processing of personal data”, that he/she also explicitly expresses his/her consent that the owner of the application can provide/transmit personal data for the purposes specified above and to companies with which he/she is in partnership relations under a concluded confidentiality commitment guaranteeing that this data is protected against accidental or illegal destruction, loss, modification, disclosure or unauthorized access and that the transmission is made in accordance with the legislation in force. The transmission of data to his/her partner must pursue the same purpose for which the personal data were collected. Also, by providing consent for the processing of data, the Customer agrees to receive marketing information, promotions, etc.
**VII. USER RIGHTS REGARDING PERSONAL DATA.**
7.1 The Customer/User benefits, in accordance with national and European legal provisions, from the following rights: the right to information, the right to access, the right to rectification, the right to erasure, the right to restriction, the right to portability, the right to opposition and the right not to be evaluated through automatic profiling. Also, the customer/user of the application has the right to seek legal action in the event of a violation of the guaranteed rights.
7.2 The Customer/User declares that once he has read the “general terms and conditions” and by checking the boxes in the SelfPay application, he/she has taken note of his/her rights and knows that they are guaranteed.
7.3 The Customer/User has the right to object at any time, free of charge and without any justification, to the processing of personal data for marketing purposes and to request the exclusion from the owners/operators database.
7.4 The Customer/User has the right to address once a year a written and dated request sent to the owner of the application at the address mentioned above and/or to the email address dpo@selfpay.ro, requesting information to confirm whether or not his/her personal data is being processed.
7.5 The Customer/User has the right to address a written and dated request sent to the address mentioned above in these “general terms and conditions” to exercise his/her guaranteed right of intervention fairly and lawfully, regarding:
a) the rectification, updating, blocking or deletion of data whose processing does not comply with the provisions of the EU Regulation 679/2016. The right can also be exercised for all the above-mentioned actions, in particular when the data are incomplete or inaccurate;
b) the anonymization of the personal data;
c) the notification to third parties to whom the data have been presented/disclosed, provided that this notification does not involve a disproportionate effort compared to the legitimate interest that could be harmed;
d) the cessation of the processing of his/her personal data to the extent that this is possible according to the purpose of the processing. The owner of the application, in his/her capacity as controller, must immediately cease the processing of the data if the purpose for which they were collected has ceased.
7.6 The Customer/User declares that once having read the terms of use of the application, he/she is aware of the fact that its owner may provide his/her personal data to the institutions within the public ministry, police, courts and other authorized state bodies based on and within the limits of legal provisions and as a result of expressly formulated requests.
**VIII. FINAL PROVISIONS**
8.1 If the services offered by Salt Bank through the “SelfPay” application are carried out at the level of a Payment Station used by SelfPay S.A., then this document called “terms and conditions” is supplemented on general aspects, with the document called “terms and conditions of use of the SelfPay Payment Station”, the vice versa being also applicable.
8.2 Any dispute shall be resolved amicably. If the parties do not resolve the dispute amicably, then the dispute shall be resolved by the courts in Bucharest, in the first instance the Court of District 2 or the Bucharest Tribunal shall have jurisdiction, as the case may be.
