TERMS AND CONDITIONS FOR THE USE OF CASH2CARD AND CARD2CARD SERVICES
1. INTRODUCTION. SCOPE OF APPLICATION
This document (“Terms and Conditions” or “Terms of Use”) sets out the terms and conditions under which Libra Internet Bank S.A. provides payment services to individual users (“you”, “the User”), namely card-to-card funds transfer services (“P2P Transfer”) and cash top-up services for cards at SelfPay Payment Stations (“Cash2Card Transfer”), hereinafter collectively referred to as the “Cash2Card and P2P Services” or the “Services”.
LIBRA INTERNET BANK S.A. is an authorised credit institution, having its registered office in Bucharest, 6-6A Calea Vitan, Sections B and C, Floors 1, 6, 9 and 13, Phoenix Tower Building, District 3, Romania, registered with the Trade Register under no. J1996000334403, having unique identification code 8119644 and registered in the Credit Institutions Register of the National Bank of Romania under no. RB-PJR-40-037/18.02.1999 (hereinafter referred to as “Libra Bank” or the “Bank”).
The services governed by this document are provided by Libra Bank in collaboration with SelfPay S.A. (“SelfPay”) and are accessed by Users through the “SelfPay Now” mobile application (hereinafter referred to as the “Application” or the “SelfPay Now Application”).
The SelfPay Now application is made available to Users by SelfPay, under separate terms and conditions, which apply independently to the relationship between the User and SelfPay. The use of the Application is governed by those separate terms and conditions and is not subject to this document.
Through the Application, Libra Internet Bank S.A. initiates and processes payment orders corresponding to transfers requested by the User. The use of the Application by the User results in the transmission of payment orders to the Bank, for the execution of Cash2Card and P2P Services, in accordance with applicable legislation and this document.
By using the Cash2Card and P2P Services and accepting these Terms and Conditions, you authorise Libra Internet Bank S.A. to initiate and execute the payment orders corresponding to the transfers requested by you through the Application. The initiation and execution of payment orders are carried out by Libra Internet Bank S.A.
For each transfer operation, the Application provides the technical infrastructure necessary for transmitting the payment order to the Bank. Subsequently, the payment order is subject to the validation and execution processes applicable to payment services. Certain technical processing operations may be performed with the support of specialised technical providers, based on contractual relationships concluded by the Bank or its contractual partners.
The Cash2Card and P2P Services are provided within the framework of an ongoing contractual relationship between Libra Internet Bank S.A. and the User, such relationship having a limited scope and applying exclusively to the performance of Cash2Card and P2P transactions. This relationship does not extend the rights and obligations of the parties beyond the provision of these services and the execution of the related transactions.
The contractual relationship between the User and SelfPay is distinct from and separate to the contractual relationship between the User and Libra Internet Bank S.A., the latter being limited exclusively to the provision and use of the Cash2Card and P2P Services. By accepting these Terms and Conditions, you acknowledge and confirm your agreement to use the Cash2Card and P2P Services in accordance with the terms and conditions set out in this document.
This document may be accessed at any time through the SelfPay Now Application, on the websitewww.selfpay.ro and may be made available to the User, upon request, in electronic format, using the contact details provided in this document.

2. ELIGIBILITY CONDITIONS FOR ACCESSING THE SERVICES
The Cash2Card and P2P Services provided by Libra Bank are available exclusively to Users who cumulatively meet the following conditions:
2.1 General Conditions
In order to access the Cash2Card and P2P Services available through the SelfPay Now Application, the User must:
a) be at least 18 years of age at the date of first use of the Services;
b) hold a single active user account in the SelfPay Now Application, such account having been created and administered under the contractual relationship between the User and the Application provider, SelfPay;
c) hold at least one eligible bank card enrolled in the SelfPay Now Application, such card having been added to the Application under the relationship between the User and the Application provider, irrespective of whether the card was previously enrolled for the purpose of accessing other services available within the Application;
d) accept this document at the time of accessing the Cash2Card and P2P Services;
e) successfully complete the remote identification process by means of video identification available within the Application.
2.2 Identification and Verification. Additional Information
In order to access the Cash2Card and P2P Services, Users must be subject to identification and verification measures, applied in accordance with the legislation on the prevention and combating of money laundering and terrorist financing.
The identification measures shall be applied within the SelfPay Now Application through the use of remote identification solutions provided by a remote video identification service provider and its subcontractors, and shall involve verification of the User’s identity based on identity documents, captured images and other information provided by the User.

Libra Bank reserves the right to request additional User identification measures in the circumstances provided for by applicable legislation or regulatory requirements.
Libra Bank may request, periodically or on an ad hoc basis, the provision of additional information or documents (relating to you, your transactions, and/or the payer and/or the beneficiary of the funds involved in your transfer), to the extent necessary to comply with legal, regulatory or internal Bank requirements. If the User fails to provide the requested information, or if such information is deemed insufficient, Libra Bank reserves the right to restrict, suspend or refuse access to the Services.
Your personal data will be automatically verified by the Bank for the purposes of customer due diligence, the prevention and combating of money laundering and terrorist financing, as well as the prevention and detection of fraud, through consultation of relevant sources, databases and systems, in accordance with applicable laws and regulations.
You accept responsibility and shall not, at any time, provide false, inaccurate, incomplete or misleading documents and/or information.
You will not be able to use the Services until you have provided the information required under these Terms of Use and/or under the Bank’s terms and internal policies.
r. 2.3. Conditions Regarding Cards and the Use of the Services
The User of the SelfPay Now Application undertakes not to breach the provisions of these Terms and Conditions, which include the following rules governing the use of the Cash2Card and P2P Services:
a) a) you shall not use a card that has been blocked by the card-issuing financial institution;
b) you shall comply with the maximum limit of 3 simultaneously active cards per User issued under the MasterCard or Visa brands in connection with which you use the Services;
c) both your cards and the cards of a P2P Transfer beneficiary are valid and issued by financial institutions in Romania. P2P Transfers and Cash2Card Transfers are also permitted between/to cards bearing a Bank Identification Number (BIN) assigned to payment instrument issuing services carried out in Romania by institutions authorised for such purpose. Any cards with a BIN corresponding to Romania may be used, provided they are issued by credit institutions, payment institutions, electronic money institutions or other entities authorised to issue payment instruments under European and national payment services regulations;
d) both you and the beneficiary of a P2P Transfer carry out transactions using personal devices and SIM cards issued by mobile network operators in Romania or in other Member States of the European Union;
e) both you and the beneficiary of a P2P Transfer are citizens or residents of Romania;
f) in accordance with the terms and conditions of the Application provider, you must not apply for more than one user account. Each User is entitled to hold only one user account within the Application. Any repeated or abusive attempt to create multiple user accounts within the Application entitles us to suspend, restrict or terminate the provision of the Services;
g) you hold a mobile device running the Android or iOS operating system, updated to the latest version available for your device;
h) you shall comply with the transaction limits set out in Section 4.3 below;
i) the enrolment of the card(s) within the Application for the purpose of using the Services must have been carried out exclusively through the completion of the Strong Customer Authentication (SCA) procedure by you or, where applicable, by your legal representatives, being an authentication and authorisation procedure involving the use of multiple security elements in accordance with the arrangements agreed with the card-issuing financial institution;
j) you must register your card by following the instructions provided within the Application. You must not attempt to register a card that is not issued in your name and/or does not belong to you and/or in breach of the contractual provisions governing the use of the card agreed with the card-issuing financial institution;
k) you must not attempt to create an account using an identity document, telephone number or email address that does not belong to you and/or is intended for single use (“disposable” / “burner”).
2.4. The Bank’s Right to Refuse the Services
Libra Bank reserves the right to refuse the provision of the Cash2Card and P2P Services where one or more eligibility conditions are not met or cease to be met, as well as in any circumstance required by applicable laws or regulations. Furthermore, the decision to accept an individual as a customer for the purpose of accessing these services rests exclusively with the Bank.
3. DESCRIPTION OF THE SERVICES
Libra Bank, in collaboration with SelfPay, makes available to Users the Cash2Card and P2P Services through the SelfPay Now Application, enabling the transfer of funds, subject to the terms of this document and applicable legislation, as follows:
(a) Transfers of Funds Between Bank Cards (P2P Transfer)
The P2P Transfer Service enables the transfer of funds, generally on an instant basis*, from the sender’s card to the recipient’s card, through the channels made available by the Visa and MasterCard card schemes, the Bank and SelfPay. The Service is provided in accordance with the service provision conditions set out in these Terms of Use.
The payment recipient may be selected using the following methods:

Transfers are sent instantly. Once initiated and submitted, a P2P Transfer cannot be cancelled; therefore, Users are requested to carefully verify the accuracy of the information entered before confirming the transaction.
The Service may be used both for transfers to the User’s own enrolled cards and for transfers to the cards of other SelfPay Now Application users.
*Important: The maximum time required for the crediting and debiting of cards involved in P2P Transfers depends on the correct implementation by the card-issuing banks of the mandatory processing flows applicable to the Visa Direct and MoneySend services provided by the Visa and MasterCard card schemes. Transfers between credit cards generally require a processing period of up to 2 Business Days, which may be extended in exceptional circumstances beyond the control of the Bank’s or SelfPay’s systems. Transfers to debit cards are generally completed within a maximum of 30 minutes from initiation; however, they may require a processing period of up to 2 Business Days, which may be extended in exceptional circumstances beyond the control of the Bank’s or SelfPay’s systems.
(b) Cash Top-Up of Bank Cards at SelfPay Payment Stations (“Cash2Card Transfer”)
The Cash2Card Transfer Service enables the funding of bank cards with funds, generally on an instant basis*, at SelfPay Payment Stations made available and operated by SelfPay, through the channels made available by the Visa and MasterCard card schemes, the Bank and SelfPay. The Service is provided in accordance with the service provision conditions set out in these Terms of Use.
Through this Service, a SelfPay Now Application User may deposit funds at SelfPay Payment Stations directly onto their own card enrolled in the Application. The Cash2Card Service may be used exclusively for funding the User’s own cards enrolled in the Application.
The transaction status (available under “Transaction Details” within the Application) is provided for information purposes only. A transaction shall be deemed successfully completed when the recipient of the funds has access to those funds.
The funds used for card funding may consist of: (i) cash; or (ii) a change voucher issued by SelfPay following the previous use of the Cash2Card Service or other SelfPay services made available to you through the Payment Stations.
*Important: The maximum time required for the crediting of cards involved in Cash2Card Transfers depends on the correct implementation by the card-issuing banks of the mandatory processing flows applicable to the Visa Direct and MoneySend services provided by the Visa and MasterCard card schemes. 4. ACCESSING THE SERVICES
4.1 Accessing the Services through the SelfPay Now Application
The Cash2Card and P2P Services provided by Libra Bank are accessed by Users exclusively through the SelfPay Now Application, which acts as the technical interface for communication with and transmission of instructions to the Bank.
By using the SelfPay Now Application, the User transmits to Libra Bank the instructions necessary for the initiation of payment orders relating to the Services. The Application provides the technical infrastructure required for the transmission of such instructions.
The initiation, validation and execution of payment orders are carried out by Libra Bank in accordance with applicable legislation, this document, and the rules of the relevant card schemes and payment systems.
The User acknowledges and accepts that the operation of the SelfPay Now Application, including its availability, is governed by the terms and conditions applicable to the use of the application, as established by its provider, SelfPay.
Each use of the Cash2Card and P2P Services takes place independently for the purpose of executing a specific payment order and does not create any obligation on the User to make repeated use of the Services.
4.2 Functionality. Personal Use
Following fulfilment of the eligibility conditions and the successful completion of the applicable identification measures, you will be able to use the Cash2Card and P2P Services available through the SelfPay Now Application, subject to the technical availability and monitoring practices of the card-issuing banks of both the payer and the beneficiary (and subject to the payment of any applicable fees and compliance with these Terms of Use).
The Cash2Card and P2P Services are intended exclusively for personal use. The User undertakes not to use these services for commercial or business purposes, for unlawful activities, including unauthorised financial transactions, for money laundering, or for any other activities that breach applicable national or international legislation. To the extent that, under applicable laws, the funds subject to the Services used by you become subject to tax obligations, such tax obligations and any procedures relating thereto shall remain solely your responsibility at all times.
4.3 Transaction Limits
Your transfers may be subject to the limits associated with the enrolled cards and the funds available thereon, as established with/by the institutions issuing the cards used.
In addition to such limits, the following transaction limits shall apply to the Cash2Card and P2P Services accessed through the SelfPay Now Application:
4.3.1 General Transfer Limits
The limits applicable to sending and receiving funds are as follows:
For the avoidance of doubt, the maximum amount that may be funded through Cash2Card Transfers, together with the amounts received through P2P Transfers, is RON 8,000 per month, while the maximum amount that may be transferred to other users through P2P transactions is RON 4,000 per month.

Each limit is calculated over a 30-day period commencing on the date of the first valid transaction, regardless of whether that transaction relates to the sending or receiving of funds.
4.3.2 Visa Card-Specific Limits.
In the case of cards issued under the Visa brand, the following maximum limits shall apply:
The transaction limits set out in this chapter apply exclusively to cash funding transactions (Cash2Card) and transfers between cards (P2P Transfers). Payments made through the SelfPay Now Application, whether at SelfPay Payment Stations or directly within the Application, do not fall within the scope of these Terms and Conditions and are subject to separate terms and conditions governing the relationship between the User and the Application provider; accordingly, such payments are not taken into account when calculating these limits.
4.3.3 Minimum Transaction Amount
The minimum amount for each P2P Transfer transaction is RON 5. The minimum amount for each Cash2Card Transfer transaction is RON 10, from which the fee applicable to the transaction shall be deducted.
4.4. Limits Regarding the Use of Change Vouchers
The use of change vouchers through the SelfPay Now Application is subject to technical limits established for the purposes of preventing misuse, preventing fraud and ensuring the secure operation of the Cash2Card Service.
4.4.1 Limits Applicable per User:
4.4.2 Resetting of Limits
Upon reaching any of these limits, the Application will display an informational message and the User will no longer be able to carry out additional Cash2Card Transfer transactions using change vouchers until the relevant period (hourly or daily) has expired.
These limits may be updated where necessary to protect Users, prevent fraud, manage operational risks or ensure compliance with regulatory requirements. Any such changes shall be communicated to Users through the SelfPay Now Application and/or by email.
4.5 Authorisation
By using the Cash2Card and P2P Services, you authorise the Bank to receive and process transfers or deposits of funds on your behalf and to deduct any applicable Fees from such funds.
Authorisation is granted separately for each payment order for the purpose of executing the relevant transaction.
The initiation of the payment orders/deposit instructions corresponding to the transfers/deposits requested by you through the Application is carried out by the Bank.
With respect to P2P Transfers, the Bank will debit the value of your transfers and any applicable Fees from the balance of your card at the time of the transaction. With respect to Cash2Card Transfers, the Bank will deduct the applicable Fees from the funds deposited at the SelfPay Payment Stations.
If you carry out a P2P Transfer or a Cash2Card Transfer, any applicable Fees shall be added to the transaction amount, so that the total amount of your transaction together with the applicable Fees will be debited from your card or, as applicable, deducted from the funds deposited at the SelfPay Payment Stations.
If you attempt to carry out a P2P Transfer that exceeds the available balance on your card at the time of the request, together with any applicable Fees, your request will not be processed.
In the unlikely event of an erroneous or duplicate transaction, you shall be required to return the amounts transferred in error or transferred twice to the accounts designated for that purpose.
In the equally unlikely event that, for any reason, a transaction is completed despite insufficient funds being available on your card, the amount due shall be repaid by you, unless the situation results from an error. In such circumstances, where the amount due must be repaid by you, you will be required to immediately deposit funds onto your card in order to cover/repay the negative balance. Until the full amount has been repaid to the Bank, the Bank may suspend your access to the Services. If the Bank considers that the negative balance was intentionally created, such conduct shall be treated as potential fraud and may be referred and reported to the relevant law enforcement authorities or other competent authorities.
5. FEES AND CHARGES
The fees and charges (“Fees”) applicable to the Services are specified in the fees section for each P2P Transfer or Cash2Card Transfer. No fee is charged by the Bank to the User for P2P Transfer transactions.
For Cash2Card Transfer transactions, the User shall be charged a fee of 1.5% of the transaction amount, but not less than RON 5 per transaction.

6. TERM, TERMINATION AND SUSPENSION
6.1 Term of the Services
The Cash2Card and P2P Services are provided at the User’s initiative, on a transaction-by-transaction basis. Access to the Services is occasional in nature and takes place exclusively following the User’s express request for the execution of a specific payment order, in accordance with these Terms and Conditions.
6.2. Termination of Access to the Services at the User’s Initiative
The User may cease accessing the Cash2Card and P2P Services at any time by refraining from initiating new payment orders or by terminating the contractual relationship with the provider of the SelfPay Now Application, in accordance with the terms and conditions applicable to the use of the Application.
Termination of access to the Application or deletion of the user account within the Application shall result in the inability to access the Cash2Card and P2P Services, without affecting any rights and obligations arising prior to such termination, including legal record-keeping and reporting obligations.
Furthermore, if you remove all cards registered within the Application, you will no longer be able to use the Cash2Card and P2P Services. If your registered card(s) expire, you will be required to register a new card in order to continue using the Cash2Card and P2P Services available through the Application.
6.3. Suspension or Termination of the Services by the Bank
Libra Bank reserves the right to refuse the provision of the Cash2Card and P2P Services, in whole or in part, with immediate effect and without prior notice, in the following circumstances, including but not limited to:
a) a) the existence of indications or suspicions of fraud, attempted fraud, money laundering or terrorist financing;
b) a material or repeated breach of these Terms and Conditions and failure to remedy the situation within a reasonable period following notification from us to do so (where remedy is possible);
c) the provision of incomplete, inaccurate or false information, or the refusal to provide information necessary for the Bank to comply with its legal or regulatory obligations;
d) the existence of indications or reasonable suspicions of unauthorised, fraudulent or unlawful use of the cards or the Services;
e) the existence of indications or reasonable suspicions that the User is attempting, directly or indirectly, to avoid or circumvent the applicable transaction limits through any practices having the effect of bypassing the limits established under this document;
f) the existence of security risks or significant risks to the User, the Bank or the systems used;
g) you act in a threatening or abusive manner towards our staff or any of our representatives;
h) obligations imposed by applicable legislation, regulations, court judgments or decisions of competent authorities.
The suspension or termination of the Services shall not affect the Bank’s right to recover any amounts due, nor the User’s obligations arising prior to such suspension or termination.
To the extent possible and permitted under applicable law, we will notify you of the suspension or termination of the Services before, or immediately after, such measure is taken, informing you of the reasons for the measure, except where such notification could compromise reasonable security measures or is prohibited by law.
7. REFUSAL TO EXECUTE TRANSFERS
Without prejudice to any other circumstances provided for in this document or under applicable law, the execution of a Cash2Card Transfer or a P2P Transfer may be refused by the Bank, including in the following cases:
a) there are insufficient funds available on your card at the time the transaction is initiated to cover the value of the transfer and any applicable Fees;
b) in the case of a Cash2Card Transfer, you have not deposited sufficient funds at the SelfPay Payment Station to cover the value of the transaction and the applicable Fees;
c) there are reasonable grounds for us to believe that you have breached these Terms of Use or applicable law;
d) there are reasonable grounds for us to consider the transfer to be suspicious, potentially unlawful or fraudulent;
e) errors, technical issues or other malfunctions occur, or refusals are received from the financial institutions issuing the cards used or from other participants involved in the processing of the transaction.
8. PROHIBITED OR ILLEGAL ACTIVITIES
The User is required to use all reasonable efforts to prevent and avoid the use of the Cash2Card and P2P Services for commercial activities, unlawful financial transactions or the laundering of illicit proceeds.
The use of the Cash2Card and P2P Services is prohibited for the purpose of:
9. INVESTIGATIONS. UNAUTHORISED TRANSACTIONS
Where, following the investigations carried out, it is determined that a transaction reported by you as unauthorised or incorrectly executed was in fact authorised by you, or that you acted fraudulently or negligently, you shall be liable for any losses resulting from the use of the Services.
For the purposes of this article, negligence includes, without limitation, the failure to keep security elements safe, such as card details, the mobile device, the Application, authentication credentials or any other security mechanisms used to access the Services.
10. SECURITY
The User is required and responsible for complying with the confidentiality and security requirements applicable to their identification and login credentials used within the Application, in accordance with the terms and conditions of the Application, as agreed between the User and SelfPay. The User is responsible for the security of their user account and the device on which the Application is installed and shall not, at any time, disclose to any person their username, passwords, card details used within the Application or any other information that could result in unauthorised access to or operation of the Application or that could enable the unauthorised use of the Services. The User understands and accepts that if a third party obtains, by any means, access to the User’s information, the User’s account within the Application or the User’s device, Libra Bank shall treat any and all transactions carried out by such third party as valid and authorised by the User, and Libra Bank shall not be liable for any loss or damage that may be suffered as a result thereof.
The User is required to notify SelfPay without undue delay if the User becomes aware of or suspects any unauthorised access to or use of the Application.
If the User does not recognise a P2P Transfer, or determines that it has been processed or executed incorrectly, or has not been processed at all, the User must promptly and without delay contact the bank that issued the card used for the relevant P2P Transfer.
Please note that Libra Bank shall not be liable to you if you incorrectly identify the beneficiary of a transfer, as payments, once executed, are final.
11. CONFIDENTIALITY AND PROCESSING OF PERSONAL DATA
For the provision of the Cash2Card and P2P Services, Libra Bank processes Users’ personal data in accordance with the legislation applicable to the protection of personal data.
The use of the SelfPay Now Application and the administration of the user account within the Application are governed by separate terms and conditions applicable to the relationship between the User and the Application provider, SelfPay. Deletion of the user account from the Application will result in the inability to access the Bank’s Services, without prejudice to the Bank’s legal obligations to retain certain data and documents.
Personal data processed in connection with the provision of the Services, including data contained in documents or records generated as a result of the execution of transactions, shall be retained by Libra Bank for the periods required under applicable legislation, including regulations relating to the prevention and combating of money laundering, accounting and archiving requirements.
Libra Bank implements appropriate technical and organisational measures to ensure the security and confidentiality of personal data and processes such data solely for the purposes and under the conditions provided by law.

Libra Bank may amend these Terms of Use from time to time. In the event of such amendments, Users will ordinarily be informed at least 60 calendar days prior to the effective date of the amendments through the communication channels made available, including email, SMS, push notifications or notifications within the Application.
The notification period set out above shall not apply to amendments required as a result of the entry into force of legal or regulatory provisions, which shall become effective on the date specified by the relevant legislative or regulatory acts.
In the event of any change to the level of the Fees or the introduction of new Fees, Users shall be informed before such Fees become applicable, within the period prescribed by applicable legislation.
Given the transactional and non-continuous nature of the Services, amendments relating to Fees shall apply exclusively to transactions initiated after the effective date of the amendments and shall not affect transactions that have already been initiated or executed.
Where applicable legislation requires a minimum notice period for changes to Fees (for example, 60 days), Libra Bank shall comply with such notice period. In the absence of such a legal requirement, the amendments may become effective within a shorter period specified in the notice provided to Users, but not less than 14 calendar days before the effective date of the amendments.
Continued use of the Cash2Card and P2P Services after the effective date of the notified amendments shall constitute the User’s acceptance of such amendments. If the User does not agree with the notified amendments, the User may cease carrying out Cash2Card Transfers or P2P Transfers at any time prior to the effective date of the amendments.
13. LIMITATION OF LIABILITY.
Libra Bank shall not be liable for any losses or damages suffered by the User arising from any of the following circumstances:
a) the inability to access the Application and/or the Services as a result of interruptions, failures or delays affecting telecommunications, internet or electricity supply services provided by third parties, as well as in the event of a fortuitous event or force majeure event;
b) the temporary unavailability of the Application and/or the Services during maintenance, technical review or update operations, including for the purpose of improving them;
c) the inability to access, or the improper functioning of, the Application and/or the Services due to the equipment, devices, operating systems or software used by the User;
d) improper use of the Application and/or the Services, including the transmission of incorrect information or data;
e) the disclosure, through the User’s negligence, of identification, authentication or access credentials to third parties;
f) unauthorised access to, compromise of, or hacking of the device or information system used by the User;
g) the disclosure of identification or access credentials for the Application as a result of phishing attacks, malware, computer viruses or other cyber threats affecting the User’s equipment or devices;
h) the requirements, conditions, limitations or restrictions applicable to the use of cards enrolled in the Application, as established by the card-issuing financial institution, as well as any breach thereof by the User.
Libra Bank’s liability towards the User shall, in all circumstances, be limited to the direct losses suffered by the User that are the direct and immediate consequence of the Bank’s failure to perform its obligations, in accordance with applicable law and the provisions of these Terms and Conditions.
14. MISCELLANEOUS PROVISIONS.
These Terms of Use are personal to you and you may not assign or otherwise transfer your rights and obligations under them. Libra Bank may assign or transfer, in whole or in part, the rights and obligations arising under this document to another entity, subject to prior notice being given to the User within a reasonable period, provided that the User’s rights are not adversely affected thereby.
These Terms of Use shall be governed by the laws of Romania. Any disputes arising out of or in connection with these Terms of Use shall be resolved by the competent Romanian courts.
These Terms of Use are drafted and concluded in the Romanian language.
Should any provision of these Terms and Conditions be or become contrary to applicable law or any mandatory legal provision, such provision shall be amended, suspended or removed to the extent necessary to ensure compliance with the law, without affecting the validity and enforceability of the remaining provisions.
Any failure or delay by the Bank in exercising or enforcing any right under these Terms of Use shall not constitute a waiver of any such right and shall not prevent the future exercise or enforcement of that right at any time.
Libra Bank may engage affiliates, group entities, agents or subcontractors in order to perform its obligations.
The rights and remedies available to the Bank under these Terms of Use are cumulative and are in addition to any other rights or remedies available to us under law.

For information, notifications or complaints relating to the Cash2Card and P2P Services provided by Libra Bank, Users may contact the Bank using the following contact details: info@librabank.ro
15.1. Support Through the Application.
SelfPay provides Users with the possibility to access real-time support sessions through the Live Chat functionality available in the “Help” section of the Application.
During a support session, you may navigate within the Application in order to carry out the necessary actions, while also benefiting from support provided in real time.
15.2. Communication with Users.
Communication with Users shall generally be carried out by email to the address provided when creating the user account within the Application. Depending on the nature of the communication, other channels may also be used, such as SMS, push notifications or notifications within the Application.
15.3. Complaints Regarding Payment Services.
Users may submit complaints regarding the Cash2Card and P2P Services as soon as they become aware of the event giving rise to the complaint, providing the information necessary to identify the transaction and the contact details for receiving the response.
Complaints may be submitted through the channels made available within the SelfPay Now Application or may be submitted directly to Libra Bank.
The User shall receive a reasoned response to the complaint within a maximum period of 30 Business Days from the date of receipt of the complaint. In order to facilitate the handling of the complaint, the User may be requested to provide additional information. In certain situations, the User may be contacted in order to obtain information from the recipient bank.
For complaints requiring complex investigations, the time limits referred to above for providing a response to the User’s complaint may be extended. In such cases, the User will be contacted within 5 Business Days from the date of receipt of the complaint and informed of the interim status of the complaint handling process.
The period for registering a complaint is a maximum of 3 Business Days from the date of its receipt. For any complaint received from a User, whether submitted in writing or verbally, the User shall receive a verbal or written response by email or by post to the address specified by the User.
Comments, suggestions or feedback relating to the SelfPay Now Application, its functionalities or its improvement are managed by the Application provider in accordance with the terms and conditions applicable to the use of the Application.
16. ACCEPTANCE OF THE TERMS AND CONDITIONS.
Acceptance of this document is completed only once, upon the first access to the Services, by ticking the relevant checkbox within the SelfPay Now Application, and such acceptance shall remain valid for all subsequent transactions carried out by the User.
Acceptance of the Terms and Conditions through the Application produces legally binding effects for the User.
If the User does not agree to this document, the User will not be able to access or use the Cash2Card and P2P Services made available by Libra Bank through the SelfPay Now Application.
Acknowledgement of the information notices relating to the processing of personal data is separate from acceptance of these Terms and Conditions and does not constitute consent to receive marketing communications, which is granted separately in accordance with applicable law.
