Information note on the processing of personal data by Selfpay SA through the SelfPay Now mobile application
In order to be able to provide the Services and the functionalities of the SelfPay Now mobile application, Selfpay SA, Romanian legal entity having its registered address in Bucharest, 153-155 Dacia Blvd., 7th floor, district 2, Trade Register number J40/9919/2009, unique company code RO26067497, will collect personal data, either directly from you, or indirectly from our partners, based on your consent given at the time of the processing, and will process such personal data.
Please read carefully and be informed about the personal data being collected and processed by Selfpay for it to be able to provide the Services described in the Terms and Conditions of Use of the SelfPay NOW mobile application (https://www.selfpay.ro/legal/selfpay-now/termeni-si-conditii/ ).
All personal data in the SelfPay Now application is processed according to the legal provisions in force and this Information Note. Its role is to inform you about the personal data that we process from or in connection with you, how we will process this data, and what your rights will be regarding the processing activities.
The purposes and categories of personal data collected and processed by Zerbapay through the SelfPay NOW mobile application.
Please find below a detailed description of the purposes and categories of data collected and processed by Selfpay through the SelfPay Now mobile application.
1.Opening of and authentication to a SelfPay Now user account
In the SelfPay Now mobile application you will be able to set up a user account and authenticate yourself to use the SelfPay Now services, at your choice, through your account opened in the Facebook social application, through your account managed by Google, or using any valid e-mail account that you are using.
Should you choose to open a user account in the SelfPay Now mobile application using a valid e-mail account that you are using, Selfpay will collect the following personal data:
The e-mail and the mobile phone number may be checked during opening the SelfPAy Now user account by sending and, after sending, validation in the SelfPay Now application of a single-use validation code.
Your authentication to the Selfpay Now user account using your e-mail account will be made by sending to your e-mail address and further verifying a single-use validation code.
Additionally, upon creating your SelfPay Now account, your phone number will receive a special symbol in the contact lists of those who have your number, when they access it through the application. This way, the information regarding the association of the phone number and the SelfPay Now account will be accurately indicated to facilitate transactions to phone numbers that have an account in the application.
Also, your mobile phone number will be used for the recovery of your user account, at your request, when the e-mail address used by you when opening the user account can no longer be accessed for any reason. Thus, in this case, you will receive an OTP code on your mobile phone number that you will continue to use when resetting your e-mail address.
1.2 Opening of and authentication to a SelfPay Now user account using Facebook
Should you choose to open a user account in the SelfPay Now mobile application through your account opened with Facebook, Selfpay will collect and Facebook will grant acess to the following personal data:
These will be used by Selfpay to automatically fill in the data needed for setting up a user account in the SelfPay Now application. Your user account will not be opened automatically based on this data, and you have the possibility to change this data during the process of opening your account with SelfPay Now.
Furthermore, the process of setting up a user account with SelfPay Now through your Facebook account will create a trust link between your Facebook user account and your SelfPay Now user account, which will allow you to directly authenticate in the SelfPay Now application while you have your Facebook application open on your mobile device.
Facebook will notify you, in the profile of your account associated with the SelfPay Now user account, every time when a trust link is created between your Facebook user account and your SelfPay Now user account.
1.3 Opening of and authentication to a SelfPay NOW user account using Google
Should yo uchoose to open a user account in the SelfPay Now mobile application through your Google account, Selfpay will collect and Google will grant acess to the following personal data:
These will be used by Selfpay to automatically fill in the data needed for setting up a user account in the SelfPay Now application. Your user account will not be opened automatically based on this data, and you have the possibility to change this data during the process of opening your account with SelfPay Now.
Furthermore, the process of setting up a user account with SelfPay Now through your account managed by Google will create a trust link between your Google account and your SelfPay Now user account, which will allow you to directly authenticate in the SelfPay Now application, on your mobile device, in your Google account used to set up the SelfPay Now user account.
1.4 Opening of and authentication to a SelfPay NOW user account using Apple (Apple ID)
Should you choose to open a user account in the SelfPay Now mobile application through your Apple ID, Selfpay will collect and Apple will grant acess to the following personal data:
These will be used by Selfpay to automatically fill in the data needed for setting up a user account in the SelfPay Now application. Your user account will not be opened automatically based on this data, and you have the possibility to change this data during the process of opening your account with SelfPay Now.
Furthermore, the process of setting up a user account with SelfPay Now through your Apple ID will create a trust link between your Google account and your SelfPay Now user account, which will allow you to directly authenticate in the SelfPay Now application, while you are authenticated on your Apple mobile device with the Apple ID used for opening the SelfPay Now user account.
2.1 In order to use some of our financial services (e.g. Cash2Card Transfer and P2P Transfer) you will need to successfully complete the remote identification process by video means available in the SelfPay Now application, which involves verifying your identity, based on the identification documents (identity card issued by the Romanian authorities) presented, the captured images and/or the information communicated, using video means. For this purpose, we use the services of the remote video identification service provider Onfido (eIDAS certified according to EU Regulation 2014/910) and some of its subcontractors.
Following the process of verifying your identity by our partner Onfido, Selfpay will collect and process the following personal data:
In all cases where financial services require, according to the legislative requirements in force, the storage of the CNP resulting from the identity verification process, the storage of the CNP in the client profile is done in encrypted form and its display is done in masked form (only a limited number of characters are displayed).

Since the financial services mentioned above are offered to users of the Selfpay Now mobile application through the partner Libra Internet Bank SA, for the partner’s compliance with the applicable legislation on know your customer and the prevention and combating of money laundering and terrorist financing (“Law no. 129 of July 11, 2019 on the prevention and combating of money laundering and terrorist financing, as well as for the amendment and completion of certain normative acts, with subsequent amendments”), following the process of identifying users of the Selfpay Now mobile application, the following data are transmitted to Libra Internet Bank SA: the user’s ID in the application; the date and time the user account was registered; the date and time of the last update of identity data; the user’s CNP, the user’s first and last name, date of birth, address, county and country, taken from the identity document; the user’s email address and phone number; the date and time the user requested the permanent deletion of the account.

2.2 To use the SelfPay Now application services, Selfpay will also collect the following personal data from you:
2.2.1 The data concerning the bank card attached to your SelfPay NOW account will not transit and will not be stored on the Selfpay infrastructure in full form, but sent by Selfpay directly to ROMCARD, the partner company authorised to process bank card payments.
Selfpay will only store in the SelfPay NOW application the anonymised information related to the bank card, namely:
Selfpay will process the financial transfer instructions received through the SelfPay NOW application based on anonymised (token) information agreed with ROMCARD, the partner company authorised to process bank card payments.
The data collected in this way are needed for:
Furthermore, the information about your bank card will be processed in case of a return/cash on delivery.
2.2.2 Selfpay will collect the date of birth to confirm the stated age of the client who wants to make financial transfers or to benefit from certain services through the SelfPay Now application. According to the SelfPay Now terms and conditions (https://www.selfpay.ro/legal/selfpay-now/termeni-si-conditii/ ), only persons who are at least 14 years old may use the services of the SelfPay Now application.
2.2.3 Collecting your home address is required as an additional security requirement to protect your financial data, according to the law on processing financial transfers through bank cards.
2.3 The data provided by the customer, necessary for the identification of payments by their beneficiary (data contained in the barcode, customer code, invoice number, payment invoice in electronic format, meaning or purpose of the payment, etc.), will be transmitted by SelfPay to the payment beneficiary and will not be processed by SelfPay for any purpose other than that necessary to make the payment. These data will be kept in the Selfpay Now records for the period mentioned below, in this document.
2.4 Other data related to the service used will be transmitted by Selfpay, to the extent that this is necessary, to the providers of the services accessed by customers and will not be stored or processed by Selfpay for any purpose other than that of performing the related services.
If your consent is obtained, in order to improve the services offered through the SelfPay NOW mobile application, and to improve the quality of its own personnel providing client support for the clients of the mobile application, Selfpay will record the conversations between you and its employees when you ask for phone assistance services.
After obtaining your consent, Selfpay will process the following personal data:

This personal data will be processed for direct marketing purposes only with your consent and by using the communication channels (e-mail, sms, alerts, notifications, etc.) that you indicated when offering your consent. In this context, it is important for you to know that we will use your consent expressed for marketing purposes until such consent is withdrawn, and it is possible to withdraw this type of consent at any time, with no justification. Withdrawing your consent will not affect the lawfulness of previous processing activities.
For the purpose of the above, you can at any time give or withdraw your consent for the processing of your e-mail address and/or phone number for marketing purposes, by making the following steps in the SelfPay NOW mobile application: Menu>Settings >Consents.
In its legitimate interest to monitor the use and performance of the Selfpay Now application, as well as the commitment of the application’s users, Selfpay uses an MMP (Mobile Marketing Platform) tracking platform. The platform collects and reports anonymous information about how users interact with advertisements and provides statistics about their behavior within the application.
The statistical data collected through the above platform is used by Selfpay for the development of its application, for the efficient optimization of its investments in various communication channels, as well as for obtaining reports on the implementation of online marketing campaigns, together with partner media agencies.
To carry out its legitimate interests and improve and take protection measures, whenever necessary, for protection when using the application and protecting users against cyber-attacks, fraud prevention and detection measures, including sending of information to the competent public authorities, measures for the management of various other risks, Selfpay will process personal data of the users of the SelfPay NOW mobile application users without in any way harming their rights and liberties.

Also, in our legitimate interest to comply with the legislation in force regarding the know your customer, as well as to defend ourselves against frauds, it is possible that, for certain transactions that you wish to carry out at the Selfpay Payment Stations, we may ask you to authenticate through the Selfpay Now mobile application.
During the transaction authentication process at the Selfpay Payment Station, the e-mail address declared by you when creating the account in the Selfpay Now mobile application will be transferred to the screen of the Selfpay Payment Station and will be used to complete the transaction. The e-mail address is thus transferred for the user’s convenience, in order to avoid manual entry errors. The user can later replace this address with any other e-mail address he wishes to use, to complete the transaction at the Selfpay Payment Station.
Whom your personal data will be sent to
Selfpay informs you that, depending on the activity/service selected by the user of the SelfPay NOW mobile application and on the purpose of collecting the personal data, it will send your data to the group companies, to third parties, or to the authorities, in order to provide its services. Selfpay will send or offer access to some of your personal data to the following categories of recipients, acting as Associate Operators or Data Processors:
The data related to the SelfPay Now application are stored by Selfpay in the EU, using the Azure cloud storage services provided by Microsoft Corporation. We assure you that we will do our best for the categories of recipients mentioned above to offer sufficient guarantees to implement adequate technical and organisational measures to ensure the security and the protection of the rights of the data subject (natural person, client/user of SelfPay NOW).
In addition, we inform you that the personal data will not be disclosed to categories of recipients outside the EU/EEA. However, if sending data outside the EU/EEA will be necessary, the transfer will be made only to entities that issue adequate guarantees about ensuring the security and confidentiality of the personal data.
For how long are your personal data collected and processed by Selfpay through the SelfPay NOW application
If you deleted your SelfPay Now user account, your personal data will no longer be kept in the SelfPay Now mobile application.
The data collected during the remote identification process by video means available in the SelfPay Now application, using the services of the remote video identification service provider Onfido (eIDAS certified according to EU Regulation 2014/910), will be kept by SelfPay in accordance with legal requirements regarding the prevention of money laundering and the fight against terrorism, according to the provisions of the civil code regarding statute of limitations, and according to the contractual terms accepted by accepting the terms and conditions, for a period of minimum 5 years after the termination of the contractual conditions assumed by accepting the terms and conditions of use of the Selfpay Now application.
In case the remote identification process by video means available in the SelfPay Now application is abandoned by the client or does not successfully complete, the data collected during the identification process are kept exclusively by the remote video identification service provider Onfido, for a period of 60 days, so that the remote identification process can be resumed or in the legitimate interest of SelfPay to keep evidences of the reasons why the identification has not been successfully achieved and to protect against identity fraud attempts. After this period, these data are permanently deleted by the remote video identification service provider Onfido.
Selfpay will keep your personal data related to the financial transactions completed through the SelfPay Now application, in accordance with legal requirements regarding the prevention of money laundering and the fight against terrorism, according to the provisions of the civil code regarding statute of limitations, and according to the contractual terms accepted by accepting the terms and conditions, for a period of minimum 5 years after the termination of the contractual conditions assumed by accepting the terms and conditions of use of the Selfpay Now application.
Separately, SelfPay will process personal data for longer periods of time, as long as they show legitimate interest to this purpose or if the legal requirements so demand, and in strict accordance with the provisions of Regulation (EU) 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
How you can update, add to or delete your personal data stored in the SelfPay NOW application
You can modify, replace or delete your personal data used when setting up the SelfPay Now user account or collected later in your SelfPay Now user profile at any time, using the security elements provided by the SelfPay Now mobile application. This includes the following data:
You can replace or delete at any time the information on your bank card associated to the SelfPay Now account, by deleting the associated card forever or replacing it with another card.
You can enable/disable at any time the use of the biometric authentication facilitated by your mobile device by accessing the Settings/Security menu in the SelfPay Now mobile application.
You can delete at any time the trust link between your Facebook user account and your SelfPay Now account, the link used for your automatic authentication to the SelfPay Now application through the Facebook application opened on your mobile device by accessing the Settings & privacy/Settings/Apps and websites/SelfPay/View and edit menus in your Facebook profile.
Deleting the trust link between your Facebook user account and your SelfPay Now account will result in the impossibility of automatic authentication through the Facebook application opened on your mobile device, and in limiting SelfPay to access your data:
used or declared in the Facebook application, unless you re-authorise access by recommencing the SelfPay Now account setting up procedure or the automatic authentication procedure through the Facebook application opened on your mobile device.
You can delete at any time the trust link between your account managed by Google and your SelfPay Now account, the link used for your automatic authentication to the SelfPay Now application through the Google account authenticated on your mobile device by accessing the Security/Signing in with Google/SelfPay NOW menus in your Google account.
Deleting the trust link between your Google account and your SelfPay Now account will result in the impossibility of automatic authentication through the Google account authenticated on your mobile device, and in limiting SelfPay to access your data:
used or declared in the Google account, unless you re-authorise access by recommencing the SelfPay Now account setting up procedure or the automatic authentication procedure through the Google account authenticated on your mobile device.
You can delete your SelfPay Now account at any time. Deleting your account will result in deletion of all your personal data collected and processed by the SelfPay NOW mobile application to provide the Selfpay services, namely:
The process of completely deleting your data from the operational systems of the Selfpay Now mobile application will last 31 days from the date of deleting your account. At the end of the 31 days, you will receive a message confirming the complete deletion of your data.
Please note that, according to the conditions specified in the Terms and conditions of use of the SelfPay Now mobile application (Legal – SelfPay Now – Terms and conditions | SelfPay ), if you do not use the Selfpay Now application for a period of up to 24 months, after this period your Selfpay Now account will be deleted from the Selfpay initiative.
Deleting your account in the SelfPay Now application will result in termination of the commercial agreement between you and Selfpay and the impossibility to use the Selfpay Services through the SelfPay Now application. To further access the SelfPay services, you will have to create a new SelfPay NOW user account.
Security of the personal data collected and processed by Selfpay through the SelfPay NOW mobile application
Selfpay undertakes to respect the security and confidentiality of personal data and makes sure that all information collected from the users of the SelfPay NOW mobile application will be stored and processed safely and treated as confidential.
Rights of the SelfPay NOW mobile application users related to the processing of their personal data by Selfpay.
In connection with the processing of your personal data, the users of the SelfPay NOW mobile application have the following rights:
a) The right to be informed (art. 13 and 14 GDPR): data subjects have the right to be informed about the identity and the contact data of the operator and their representative, the contact details of the data protection officer, the purpose and the legal grounds of the processing, the recipients or categories of recipients, information about data transfer to a third country, adequate guarantees, storing time, the right to complain, any consequences of providing the data, the existence of an automatic decision-making process.
b) The right to access (art. 15): The persons’ access right is respected by SelfPay and concerns the following: confirmation about the data processing, access to the processed data, providing a copy of the personal data that is subject to processing, obtaining additional information (against a reasonable charge), remote access through a system allowing data viewing by the data subject, checking of the identity of the person requesting information.
c) The right to rectification (art. 16 and art. 19): The persons’ right to data rectification is respected by SelfPay and concerns: rectification of indexed data, updating/adding/modification of the data. Thus, the users can make any modifications or updates to the personal data directly from the user account, by accessing the Menu > Profile > Edit section
Thus, users can modify the mandatory personal data at any time and/or insert/delete optional personal data.
d) The right to data deletion (art. 17 and art. 19 GDPR): SelfPay respects the right of the data subjects to have their data deleted, in the following circumstances: the personal data is no longer necessary for fulfilling the purposes for which it was collected or processed; the data subject withdraws their consent based on which the processing takes place, and there are no other legal grounds for the processing; the data subject opposes processing, and there are no superseding legitimate reasons for the processing, or the data subject opposes processing for direct marketing purposes; the personal data was processed unlawfully; the personal data must be deleted to comply with a legal obligation of Selfpay.
Exceptionally, even if one of the above-mentioned conditions is fulfilled, this right does not apply if keeping the personal data is necessary for one of the following reasons, applicable to Selfpay:
e) The right to restrict processing (art. 18 and art. 19 din GDPR): the data subject may obtain to restrict the processing of personal data in certain situations expressly regulated by law (especially when they challenge the accuracy of that data, for the period needed to determine such inaccuracy, or if the processing is unlawful and the person does not wish the data to be deleted, opting to restrict processing). In such situations, except for storing the data, the data will no longer be processed.
f) The right to portability (art. 20 GDPR): According to the GDPR provisions, SelfPay respect the persons’ right to portability of their own data in a simple, easy to read format, and the right of the person exercising the right to send the data to another operator of choice. To this purpose, SelfPay implemented a feature in the application allowing for extraction of the personal data processed through the application, which can be accessed in the following way: Menu>Profile > Edit > Extract data.
g) The right to oppose processing (art. 21 GDPR): It can only be exercised for the following purposes: direct marketing; research, scientific, historical, statistic, based on the legitimate interests of the operator or of a third party.
h) The right to not be evaluated through automatic profiling (art. 22 GDPR): the data subject has the right not to be subject to a decision solely based on automatic processing, including profiling, producing legal effects that concern the data subject or affect it similarly to a significant extent, except if the data subject has given their consent for this.

What are cookies?
A cookie is a small-size file, a special text, often coded, sent by a server to a web browser and then sent back (unchanged) by the browser, every time when that server is accessed. The cookie is installed by the request sent by a web server to a browser (e.g., Internet Explorer, Chrome, Mozilla), and it is fully “passive” (it does not contain software, viruses or spyware, and it cannot access information on the user’s drive). Cookies are used to monitor user behaviours; some of the typical applications are to remember the user preferences and implement the “shopping cart” system. Cookies ensure a pleasant browsing experience for the user and support SelfPay’s efforts to offer convenient services to its users, e.g., online privacy preferences. What types of cookies does SelfPay use?
SelfPay uses two types of cookies: per session, and fixed cookies (temporary files that remain in the user’s terminal until the end of the session or until the application/web browser is closed).
Fixed files remain on the user’s terminal for a period within the parameters of the cookie or until deleted by the user manually. The cookies used by the operator’s partners, including, but not limited to the users of the web page, are subject to that respective confidentiality policy.
A visit on the SelfPay Now website or application will place the necessary cookies, which are essential for you to receive the Services, and for which your consent is not needed.

The personal data collected by the use of cookies will only be collected to facilitate certain features for the user, and is encrypted in a way that makes it impossible for unauthorised persons to access it. In general, an application used for accessing web pages allows cookies to be saved on the terminal by default. Security clarifications and confidentiality matters
Cookies are NOT viruses, and they use plain text formats; they are not made of pieces of code, so they cannot be executed or run by themselves. According to the requirements of Regulation (EU) no. 679/2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter “GDPR”), LIBRA INTERNET BANK S.A. has the obligation to process the personal data provided by you safely and solely for the specified purposes.
The purpose of collecting such data is to provide financial-banking services and operate the SelfPay Now application. Your refusal results in the impossibility to process the payment through the SelfPay Now application.
Processed information
The information is collected for the purpose to identify users in the authentication or payment process. The collected information is:

Information accuracy
a) The right to access the data: the right to obtain from the Bank, upon request and free of charge, confirmation that the data about me are processed or not by it. This right can be exercised by sending a request at the e-mail address protectiadatelor@librabank.ro, with the name clearly mentioned.
b) The right to rectify the data: the right to obtain the rectification or updating of incomplete or inaccurate data.
c) The right to oppose processing: the right to oppose processing of data about me, for reasons related to my specific circumstances. LIBRA INTERNET BANK S.A. will continue the processing if it has a legal obligation to do so or when it proves a legitimate interest that supersedes my interests, rights and liberties, or when the processing is done for the purpose to ascertain, exercise, or defend a right in court.
d) The right to delete the data: The Bank has the obligation to delete the personal data of the data subject, with no unreasonable delay, if one of the situations mentioned at art. 17 GDPR applies.
e) The right to restrict processing: can be obtained in the circumstances described at art. 18 GDPR.
f) The right to data portability: the data subject has the right to obtain the personal data provided to the Bank in a structured format, and provide such data to another operator.
g) The right not to be subject to an individual automated decision-making process: the right not to be subject to a decision solely based on automatic processing, including profiling, which generates legal effects for the data subject.
h) The right to approach the supervisory authority: the right to file a complaint with the National Personal Data Processing Supervisory Authority, to protect the rights guaranteed by law.
To enable use of the application and the connected facilities, data concerning the bank card (card number, expiry date, card holder name) will be stored. Such data will be disclosed to third-party contractual partners involved in carrying out the contract or ensuring the provision of products and services related to the banking activity (processor, card organisations, issuing banks), and for maximum safety, the security code (CVV2, CVC2) will not be stored.
