SelfPay Payment Stations (“Payment Stations” or, individually, “Payment Station”) are operated by SelfPay S.A., a company with its registered office in Bucharest, Dacia Boulevard no. 153–155, floors 5–7, district 2, Romania, registered with the Trade Register Office under no. J2009009919407, with the tax identification number RO26067497 (hereinafter referred to as “SelfPay”).
This document (“T&Cs” or “Terms and Conditions”) regulates the use of SelfPay Payment Stations, including the execution of transactions through them, accessing the products, services and functionalities available at the Payment Stations and the general conditions of use applicable to the persons using the Payment Stations (the “User”).
SelfPay Payment Stations are multifunctional, self-service, unassisted devices, located in locations throughout Romania, which allow Users, through a single interface, to make payments, purchase products and services, and access services provided by third-party partners.
By using the Payment Station, the User confirms that he/she has read, understood and agrees to comply with the Terms and Conditions of Use, in the form available at the Payment Station at the time of use. The use of the Payment Station to initiate a transaction represents a full acceptance of this document.
If you do not agree with any of the provisions of this document, please do not use the Payment Stations or the functionalities, services, products, information, materials or the like available through them.
This document can be consulted at any time through the Payment Station interface, on the website www.selfpay.ro or can be made available to the User, upon request, in electronic format, using the contact details provided in Section 20 of this document.
SelfPay Payment Stations allow Users to access, through a single interface, various functionalities, services and products.
Payment Stations are designed to facilitate:
Certain services and products are available exclusively at Payment Stations, while others can also be accessed via the SelfPay Now mobile application, which is subject to separate terms and conditions. The range of services and products available may vary from one Payment Station to another, depending on the location, technical configuration and available partners.
To use the SelfPay Payment Stations, the User must:
SelfPay Payment Stations are intended for use by adults who have reached the age of 18.
The persons with limited legal capacity who have reached the age of 14 but have not reached the age of 18 may use the Payment Stations only to the extent that they have the legal capacity to conclude legal acts related to the operations carried out through them, in compliance with the applicable legal provisions and, where applicable, with the approval or assistance of legal representatives.
Certain services and products available at the Payment Stations are intended exclusively for the persons who have reached the age of 18, including, but not limited to: the purchase of Lotto game tickets and any other products in the field of gambling (see Annex no. 1), the purchase of electronic money and the funding of electronic money accounts (see Annex no. 2), as well as any other services indicated as such in the Payment Station interface. In these cases, the Users who have not reached the age of 18 are not authorized to access or use the respective services or products.
The risks of false declaration belong exclusively to the User.
Access to certain services available through Payment Stations may be subject to meeting additional requirements, which may include, but are not limited to:
Such specific conditions will be communicated to the User through the Payment Station interface, before accessing or using the respective service, and will take precedence over the general conditions, to the extent of their applicability.
The User will be able to use the Payment Station, the functionalities and services available through it exclusively in accordance with these Terms and Conditions, with the documents mentioned in these Terms and Conditions, with the instructions for use displayed in the Payment Station interface, in compliance with applicable legislation and only for legitimate purposes and in good faith.
The actions taken by the User in violation of the instructions for use or the conditions provided for in this document (including, without limitation, age conditions or the provision of data such as a valid e-mail address, when required) do not constitute a basis for SelfPay to assume any obligations to provide services or to grant subsequent support.
To the extent that, according to applicable laws, the amounts of money that are the subject of transactions made or services accessed by the User become subject to tax obligations, these obligations and any procedures in relation thereto fall exclusively on the User.
The User is responsible for the accuracy, completeness and correctness of all data entered at the Payment Station, including the identification data of the payment beneficiaries (selected provider), the customer code, the contract number, the telephone number, the e-mail address, the payment amounts, the payment references and any other information necessary to execute the operations.
The User is obliged to carefully check, before inserting cash or authorizing the card payment, the correctness of all data displayed on the Payment Station screen, including the selected provider, the payment identification data and the payment amount. The confirmation of these data and making the payment represent the full acceptance of the transaction.
Unless expressly provided otherwise, SelfPay does not verify or validate the information provided by the User within the payment flows or the identification of the payment beneficiaries. SelfPay is not responsible for the consequences of incorrect identification of the payment beneficiary or of the provision of erroneous data by the User.
In accordance with the applicable legal provisions, this document and the specific terms of the third-party payment service providers, the payment operation cannot be revoked after the moment of receipt of the related payment order.
For the transactions carried out through the SelfPay Payment Station, the moment of receipt of the order for carrying out a payment operation coincides, as the case may be, with:
Starting from the time provided above, the transaction is considered final, and SelfPay does not make corrections on the elements of the transaction, regardless of their nature, including, but not limited to: corrections regarding the payment provider/beneficiary (in case of erroneous selection by the User) or corrections regarding the customer code, the subscriber code, the contract number, the telephone number or any other identifier entered by the User.
Until the transaction is completed, the User can cancel the operation by pressing the “Back” and “Cancel” options on the touch screen (option available only for cash payments and/or using a receipt with remaining value). Also, the transaction is automatically cancelled after 2 (two) minutes and thirty seconds of inactivity, according to the Payment Station’s operating mode.
In the event that:
the amounts entered and not recovered by performing the operation will be made available to the User by issuing a receipt with the remaining value (in the case of cash payments or when the banknotes inserted cannot be returned) or, as the case may be, by returning the amount to the card used, under the conditions set out in Sections 5 and 6.
The User may subsequently retry performing the operation, to the extent that the service is available.
The moment of the payment acceptance is visually confirmed on the Payment Station screen, as the last screen displayed to the User and/or by a corresponding document – the payment confirmation (receipt) issued by the Payment Station and/or through the SelfPay Now Application (the “Payment Confirmation”).
The User is obliged to keep the Payment Confirmation issued until receiving payment confirmation from the payment beneficiary or, as the case may be, until receiving the purchased product or service. The Payment Confirmation contains the transaction identification elements, including the 4-letter identification reference, necessary for identifying the transaction in relation to SelfPay Customer Service.
The issued Payment Confirmation certifies the acceptance of the payment and represents a proof of its execution. It does not represent a fiscal document within the meaning of tax legislation and does not substitute the documents issued by the payment beneficiary or the relevant supplier (invoice, fiscal receipt, game ticket, order confirmation, etc.), should these apply.
In the event that, for objective reasons (lack of paper, paper jammed in the printer, technical failure or other causes beyond the control of the User or any other situation in which a payment confirmation is not issued at the Payment Station), the Payment Station does not issue the Payment Confirmation, the User may contact SelfPay Customer Service through any of the channels provided in Section 20, in order to obtain a duplicate.
In order to communicate the duplicate, the User is obliged to provide a valid e-mail address, which he/she can access, as well as the information necessary to identify the transaction requested by SelfPay. In the absence of providing a valid e-mail address and the necessary information requested by SelfPay, SelfPay is exempted from any obligation to communicate the duplicate of the Payment Confirmation, the receipt with the remaining value or any other information related to the transaction.
If the requested Payment Confirmation contains a code, a PIN or other elements or data necessary in order to benefit from certain services, SelfPay reserves the right to request additional documents or information for the validation/identification of the User, before reissuing them.
The specific conditions regarding the recovery of the receipts related to electronic money products are provided in Annex no. 2.
Cash payment is made by inserting banknotes into the banknote acceptor of the Payment Station. Banknotes are checked and accepted by the automatic receiving and checking mechanisms of the Payment Station. The payments are accepted exclusively in the national currency (lei).
Payment Stations do not, by design, have the technical ability to issue change in cash. The User is informed about this aspect during the use of the Payment Station and is asked to insert the amount corresponding to the desired operation into the banknote acceptor. In certain cases, the Payment Station may return the last banknote inserted.
If the User has inserted an amount greater than the payment amount for the desired operation, the Payment Station displays a warning message with the following options, depending on the nature of the operation:
At Payment Stations equipped with POS terminals, payment can be made via payment cards. The services for accepting card payment operations are provided to SelfPay by a partner accepting bank, through POS equipment installed at the Payment Stations.
Authorization of card payment is carried out in accordance with the applicable authentication and authorization mechanisms established by the card issuing bank and the Visa or MasterCard payment schemes. SelfPay does not intervene in the authorization process carried out by the issuing bank and cannot influence its conditions or decision.
Refunds related to card payments. In the case of payments made with a payment card, any refund will be made exclusively by refunding the amount to the same card with which the transaction was paid. These provisions do not affect the issuance of receipts with remaining value under the conditions of Section 6.1 nor their cancellation, with the refund of the amount to the card, under the conditions of Section 6.4.
POS technical incident – debiting the card without completing the payment. In exceptional cases where the card transaction is declined but the amount is debited, SelfPay will verify the collection in its accounts and communicate the resolution to the User within a maximum of 3 (three) business days. If the collection is confirmed, the payment to the payee will not be processed, and the amount will be refunded exclusively to the card originally used. The refund may take 3–5 business days, or a longer period of time beyond the control of SelfPay, depending on the card issuing bank and the partner acquiring bank.
The amounts highlighted on the receipts with remaining value issued by the Payment Stations can be used to make payments at any SelfPay Payment Station, by scanning the barcode or manually entering the numerical code related to the receipt with remaining value, under the conditions provided in Section 6. The operation of scanning and using the receipt with remaining value is equivalent to inserting cash into the Payment Station.
At certain Payment Stations, the payment can also be initiated by scanning a QR code displayed on the Payment Station screen, using the SelfPay Now mobile Application and a card enrolled in it or through the Google Pay or Apple Pay service available in the application. In this case, the card payment operation is authorized by the technical infrastructure integrated in the Application, and acceptance of the payment leads to the continuation of the operation carried out at the Payment Station. Use of the SelfPay Now Application is governed by the terms and conditions applicable to it.
Since the Payment Stations cannot issue change in the form of cash, any amount due to the User as change or refund in connection with an initiated and/or completed operation is made available to him by issuing by the Payment Station a document (referred to in this document as “receipt with remaining value”) that highlights the amount to be refunded to the User, along with a barcode (for scanning) and a numeric code (for manual entry), which uniquely identifies the operation and the amount to be refunded.
The remaining receipt highlights the User’s claim against SelfPay and does not involve any cost for the User. Remaining receipts may be issued by the Payment Stations exclusively in the following situations:
In the event of a card payment that cannot be completed, the issuance of a receipt with remaining value is intended to offer the User the opportunity to use the funds immediately (by using the remaining value for a new payment), as an alternative to waiting for the refund deadlines specific to card schemes. If the User does not use the remaining value on the receipt by the next business day, the receipt is cancelled and the amount is refunded to the card used.
Payment Stations may not under any circumstances be used to voluntarily obtain receipts with remaining value, without first inserting cash into the banknote acceptor or without making a payment through the POS terminal installed at the Payment Station in order to settle payment obligations, purchase products, goods or services.
The remaining value on the receipt can be used by the User exclusively through the SelfPay system, in one of the following ways:
The liability for sending incorrect bank details belongs exclusively to the User, SelfPay not being held responsible for the payment made based on the information communicated by him.
Due to existing technical limitations, receipts with remaining value issued in the form of a barcode have a validity period of 6 (six) months from the date of issue, the date and time of expiration being mentioned directly on the receipt with remaining value.
Blocking in case of uncertainty. In exceptional situations, when the status of the transaction at the payment beneficiary or the relevant supplier cannot be confirmed, SelfPay may temporarily block the use of the remaining value issued on the receipt. Their unblocking or cancellation will be done after receiving confirmation from the beneficiary/supplier. The settlement term depends on the relevant beneficiary/supplier; SelfPay does not guarantee a response time and cannot be held liable for delays or for the temporary inability to use the credit receipt until the transaction status is clarified.
Cancellation of credit receipts related to card payments. In the case of failed, cancelled or rejected card payments, SelfPay may cancel the credit receipt on the business day following the transaction, as a fraud prevention measure. The related amount will be refunded to the card originally used, according to applicable banking rules and terms.
If, due to an error, the User receives a value greater than the balance shown on the Payment Confirmation or collects/uses the same receipt with remaining value several times, as well as in any other situation in which, as a result of a technical, operational or processing error, a receipt with remaining value is issued or a value is granted that does not correspond to the operation actually performed, including in the situation where the payment transaction was successfully processed and the service or product was provided, SelfPay is entitled to request the refund of the undue amounts thus collected/used by the User and/or to proceed with their compensation, under the terms of the law.
Also, if, due to a technical error in the computer application or the Payment Station or as a result of the User’s action, the User pays for services and/or products at derisory prices (well below their real value), SelfPay has the right to cancel the transaction, with the return of the amounts of money paid by the User.
SelfPay has the right to request that Users who, through fraud (including by using the remaining amounts on the receipt belonging to other persons without their consent or by exploiting system vulnerabilities), illegally manage to carry out operations through the Payment Stations, return the amounts of money, failing which, SelfPay will take all legal steps to recover them.
In all situations provided for in this article, as well as whenever necessary to remedy a technical or operational error, preventing fraud or clarifying a non-compliant situation, SelfPay reserves the right to make all technical and operational corrections necessary to remedy the error and reflect the real situation of the transaction, including, without limitation, cancelling, suspending or modifying the value of erroneously issued receipts with remaining value, temporarily blocking their use until the situation is remedied or clarified, as well as making any necessary adjustments to its records and IT systems.
Through the Payment Stations, Users can access various services, products and functionalities made available by SelfPay and/or third-party partners. These may include, but are not limited to:
Payments made at Payment Stations to providers/beneficiaries available in their interface are accepted and processed by SelfPay based on contracts concluded by SelfPay directly with the respective beneficiaries (“Payment Beneficiaries”) or, as the case may be, based on contractual relationships with partner financial institutions set out in Section 7.3.
Within these operations, SelfPay provides services exclusively for the benefit of Payment Beneficiaries. SelfPay does not provide payment services to Users, does not open payment accounts on their behalf and does not act as a payment service provider for Users.
The User’s payment obligations towards the Payment Beneficiary are considered extinguished at the time established by the latter, after the successful acceptance and processing of the operation at the Payment Station, according to the Payment Confirmation.
The subsequent transfer of funds by SelfPay to the Payment Beneficiary is carried out under the conditions contractually agreed with the latter and does not affect the User.
The time frame for the actual allocation of the amounts in the systems of the Payee (e.g., the settlement of the debit in the provider’s records) depends on its internal procedures. Information on the estimated processing times is displayed, where applicable, on the Payment Station screen and/or on the Payment Confirmation. In the event that the Payee delays the actual allocation of the amounts, SelfPay cannot be held liable for this delay. Upon the User’s request, SelfPay may provide proof of the transfer of funds, which attests to its successful completion.
SelfPay does not process returns or refunds in connection with the purchase of services or products or any payments to the Payees or any requests in connection with them. Requests for returns or refunds are addressed directly to the Payees, according to their policy.
Through the Payment Stations, Users can also access payment services provided by authorized partner institutions. In these cases, the payment service is provided to the User by the relevant partner institution, based on its terms and conditions, which are brought to the attention of the User through the Payment Station interface before the payment is made, and the contractual relationship related to the payment service is established directly between the User and the respective institution.
Within these services, SelfPay acts as a provider of the technical access infrastructure (Payment Stations) and, where applicable, as a service provider of the relevant payment institution, without providing the respective payment services in its own name to the Users.
Through the Payment Stations, Users can purchase electronic money (including in the form of vouchers/codes) and top up electronic money accounts opened with authorized electronic money issuers from European Union member states, which provide services on the territory of Romania in accordance with the applicable legislation (“Issuers”).
Within these operations, SelfPay acts exclusively as a distributor of electronic money issued by the Issuers, pursuant to the distribution contracts concluded with them. The electronic money is issued by the relevant Issuer, and the contractual relationship regarding the electronic money is established directly between the User and the Issuer, based on its terms and conditions, brought to the User’s attention before the transaction is completed.
SelfPay does not issue electronic money, does not hold, does not manage and does not have access to the Users’ electronic money accounts and does not provide payment services to Users in connection with these operations. The specific conditions applicable to these services are set out in Annex No. 2.
Certain products and services available at Payment Stations (such as electronic top-ups for prepaid mobile cards, prepaid satellite TV services, game licenses and vouchers for online platforms or top-ups of transport cards) are purchased by SelfPay from the relevant suppliers and resold by SelfPay in its own name to Users.
In these cases, the sale price is displayed on the Payment Station interface before the purchase is completed and the related sales documents are issued in accordance with the applicable law. The commercial name of certain top-up services may include values expressed in euros. These values identify the telecommunications services offered by the operator and do not represent amounts in foreign currency sold or exchanged to the User. The use of the purchased products or services remains subject to the relevant supplier’s terms and conditions (e.g. the terms and conditions for the use of top-up codes).
Certain products and services available at the Payment Stations (such as vignettes and tolls, event tickets, transport tickets, software licenses, e-sim data, gift vouchers, vehicle history reports or Lotto game tickets) are distributed by SelfPay as agent or intermediary, on behalf of and for the account of the relevant providers, pursuant to distribution and/or mandate contracts concluded with them.
In these situations, the relevant provider is identified within the purchase flow in the Payment Station interface, the contractual relationship regarding the respective product or service is established between the User and the relevant provider, and the use of the product or service is subject to the terms and conditions of the provider. The specific conditions regarding the purchase of Lotto game tickets are set out in Annex no. 1.
Except for situations where the contrary is expressly provided, SelfPay is not the provider of the product or service distributed and is not responsible for its content, quality, conformity or execution.
This document governs the use of SelfPay Payment Stations and the functionalities made available by SelfPay through them. The specific conditions applicable to certain services, products or functionalities may be presented: in the Payment Station interface, in the annexes to this document, in separate terms and conditions of the relevant suppliers or partners or through other documents or information made available to the User before accessing the respective service.
In the event of the existence of separate terms and conditions applicable to a certain service, product or functionality, these shall prevail to the extent that they specifically regulate the respective service, product or functionality.
SelfPay may introduce new functionalities, services or products to the Payment Stations, including services provided by third parties or partner financial institutions. These may be subject to additional conditions, separate terms and conditions or specific eligibility requirements, which will be communicated to the User before using the respective functionality or service.
The functionalities, services and products available through the Payment Stations may be modified, limited, suspended, removed or supplemented from time to time, depending on the commercial decisions of SelfPay, the availability of the relevant providers, technical conditions or applicable legal and regulatory requirements. Their availability may vary depending on the Payment Station, the geographical area, the technical conditions and the policies of the providers or financial institutions involved.
SelfPay does not guarantee the continuous availability of all functionalities, services or products at the Payment Stations and does not guarantee the availability, execution, quality or conformity of services or products provided by third party partners.
The use of SelfPay Stations is free of charge.
However, certain services, products or functionalities available through the Payment Stations may be subject to applicable fees, charges, costs or other amounts, depending on the nature of the service or functionality accessed.
The fees or charges applicable to services and functionalities provided directly by SelfPay are established by SelfPay and are displayed in a clear and transparent manner:
The User is informed of the existence and amount of any applicable commission or fee immediately after selecting or accessing the respective service and, in all cases, before confirming the operation.
If the User does not agree with the applicable commissions or fees, he may refrain from performing the operation or using the respective service before its final confirmation.
The commissions, fees or other costs applicable to services provided by third parties or partner financial institutions through the Payment Stations are established by the respective providers and are communicated to the User in accordance with the terms and conditions applicable to the relevant service.
In the case of payment services provided by partner financial institutions, the applicable commissions and financial conditions are regulated by the contractual documentation specific to the respective provider and are brought to the attention of the User through the channels and in the manner established by the latter, including, where applicable, within the operational flow available at the Payment Station. SelfPay reserves the right to introduce, modify or eliminate fees and charges applicable to the services and functionalities provided directly by it.
Transactions performed through Payment Stations may be subject to transaction limits (including value limits per transaction, per product or per time interval), established by SelfPay, the payment beneficiaries, the e-money Issuers, the partner financial institutions or the applicable legislation. Also, certain transactions may be unavailable or may be refused as a result of operational limitations applicable to the Payment Station or the partners involved in its operation. These limits are applied automatically, and transactions exceeding them cannot be accepted.
Payment Stations also have technical limitations, including: the impossibility of issuing cash in the form of change, the types and denominations of banknotes accepted, as well as other restrictions displayed in the Payment Station interface or resulting from its technical configuration.
SelfPay may update operational limits whenever necessary, to protect Users, prevent fraud, manage operational risks or comply with applicable legal, regulatory or contractual requirements.
In order to comply with applicable legal requirements, to prevent fraud and to ensure the security of Payment Stations and the services available through them, accessing certain services may be conditional on providing the User’s identification data (including PIN), and in certain situations additional checks may be required.
In the event that a transaction is considered suspicious, in accordance with the applicable legal provisions on the prevention and combating of money laundering and terrorist financing, SelfPay may request the User to provide additional information and/or documents necessary for his/her identification, including a copy of the identity document. The requested documents will be transmitted through one of the communication channels indicated by SelfPay, within the period communicated to the User.
Refusal or inability to provide the requested information or documents may lead to the refusal, limitation or suspension of access to the services for which these checks are necessary, including the temporary blocking of the use of receipts with remaining value or the postponement of the processing of refunds, under the terms of the law.
SelfPay may be prevented, for legal or regulatory reasons, from communicating to the User the exact reasons for the request for information. The User understands and accepts that the absence of a detailed explanation does not affect the binding nature of the request. The data and documents provided by the User will be processed in accordance with the Information Note on the processing of personal data, available at the Payment Station and on the website https://www.selfpay.ro/legal/statia-de-plata/legal-statia-de-plata-politica-de-confidentialitate/ and with the provisions of Section 14 of this document.
The User is obliged to make every effort to prevent or hinder the use of the Payment Stations and the services available through them for illegal or unauthorized purposes. It is prohibited to use the SelfPay Payment Stations for or in connection with:
SelfPay cooperates with the competent authorities and may notify the competent state bodies if it finds or suspects the use of Payment Stations for illegal or fraudulent purposes.
It is the User’s obligation and responsibility to:
The User is obliged to contact SelfPay as soon as he/she notices or suspects that:
Any delay in notifying SelfPay may affect the possibility of remediation and may make the User liable for any losses incurred.
SelfPay will never request Users, via email, SMS, telephone or other channels:
The User must not comply with such requests and must report them to SelfPay using the official contact details provided in this document.
SelfPay is not liable for losses suffered as a result of the User disclosing such data to third parties or making payments or cash deposits at the request of third parties, including as a result of phishing attacks or other fraudulent schemes.
SelfPay has the right to temporarily suspend the provision of services through the Payment Stations in the event that there is no technological possibility of interaction between the payment beneficiaries or relevant suppliers or intermediaries and the User, as well as during the periods necessary for maintenance work, technical revision, modernization of the IT application and/or the Payment Stations.
SelfPay reserves the right to refuse to perform certain operations, to limit access to certain services or to adopt other restrictive measures, including, but not limited to, the following situations:
SelfPay makes reasonable efforts to remedy technical issues reported in connection with the Payment Stations.
In order to provide the services and functionalities available through the Payment Stations, SelfPay and, where applicable, the relevant partners involved in the provision of certain services may process the Users’ personal data, in accordance with the applicable legislation on the protection of personal data.
Data processing may be necessary, including for the processing of transactions, the provision of accessed services, the issuance and transmission of confirmations and duplicates, the resolution of requests and complaints, the prevention of fraud, the fulfilment of legal obligations in the field of preventing money laundering and terrorist financing, ensuring the security of the Payment Stations and compliance with other applicable legal obligations.
Complete information on the categories of data processed, the purposes and grounds of the processing, the recipients of the data, the storage period and the rights of the Users are available in the Information Note on the processing of personal data, available at the Payment Station and on the website https://www.selfpay.ro/legal/statia-de-plata/legal-statia-de-plata-politica-de-confidentialitate/. By using the Payment Stations, the User confirms that he has taken note of this information.
SelfPay is the owner of the rights to the SelfPay software application used within the Payment Stations in the SelfPay network, including the design, graphic interface (look & feel), know-how, databases accessible through it, as well as all related content elements or, as the case may be, has the right to use these elements pursuant to a license, permission or other right granted by their owners.
The respective elements are protected under applicable intellectual property law, including copyright and related rights legislation, or are used by SelfPay under a license or with the permission of its partners.
Any use of the application, content or design elements for purposes other than those expressly permitted by this document or by applicable law is prohibited. The content may not be reproduced, copied, translated or modified in any way, in part or in whole, without the prior written permission of SelfPay.
Nothing in the content displayed at the Payment Stations should be construed as granting, by implication or otherwise, any license or right to use any displayed trademark without the written permission of SelfPay or the relevant owner. In the event of infringement of intellectual property rights, SelfPay will resort to all necessary and applicable legal means.
SelfPay may modify, update, suspend, limit or eliminate, in whole or in part, functionalities, services, products, content, features or components of the Payment Stations, including as a result of technical, operational, commercial, security or legal or regulatory compliance needs.
The availability of certain services, products or functionalities may depend on the fulfilment of technical, operational or legal conditions; the availability of relevant payment beneficiaries, suppliers or partners; as well as the acceptance of additional terms and conditions, where applicable.
SelfPay reserves the right to periodically modify this document, as well as any annexes, rules or special terms and conditions applicable to the use of the Payment Stations and/or the services available through them.
The updated version of the Terms and Conditions is brought to the attention of Users through the Payment Station interface and/or by publishing on the website www.selfpay.ro, until the time of providing the services and making the payments. The conditions applicable to each transaction are those displayed and accepted at the time of making the respective transaction.
If the applicable legislation requires compliance with notification deadlines or special conditions for certain changes, these will be applied in accordance with the respective requirements. The continued use of the Payment Stations after the changes enter into force constitutes the acceptance of those changes by the User. If the User does not agree with the applicable changes, he may cease using the Payment Stations at any time.
The Payment Stations are made available to Users in the form in which they exist at the time of use (“as-is”), without guaranteeing that they will function without interruptions, errors or technical imperfections. SelfPay makes reasonable efforts to ensure the proper functioning of the Payment Stations, but cannot guarantee that all deficiencies will be identified and remedied immediately after their occurrence.
SelfPay does not guarantee the availability, execution, quality or conformity of products or services provided by third parties through the Payment Stations and is not liable for their acts or omissions.
To the extent permitted by applicable law, SelfPay is not liable for direct or indirect damages suffered by the User or third parties as a result of:
The above limitations do not affect the rights conferred on consumers by mandatory legal provisions.
This document governs the use of SelfPay Payment Stations and constitutes the agreement between SelfPay and the User regarding their use, in addition to any specific terms and conditions applicable to certain services, products or functionalities available through the Payment Stations.
SelfPay may transfer, assign, delegate or subcontract, in whole or in part, the rights and obligations resulting from this document to affiliates, partners, successors, subcontractors or other entities involved in the operation of the Payment Stations or in the provision of services available through them, without affecting the User’s rights provided by law.
This document is governed by the laws of Romania. Any dispute shall be resolved, to the extent possible, amicably. Any dispute arising from or in connection with the use of the Payment Stations or this document shall be resolved by the competent courts of Romania, in accordance with applicable law.
This document is written in Romanian. Any translation into another language is provided for informational purposes only. In the event of differences between versions, the Romanian version shall prevail.
If any provision of this document is deemed invalid, illegal or unenforceable, this shall not affect the validity of the remaining provisions, which shall continue to be effective to the extent permitted by law. The fact that SelfPay does not exercise or enforce a right provided for in this document does not constitute a waiver of that right. The rights and remedies provided for in this document are supplemented by any other rights and remedies available under applicable law.
Any suggestions, ideas, recommendations, observations, comments or other communications transmitted by the User to SelfPay regarding the Payment Stations or the services available through them may be used by SelfPay without any restriction and without the obligation to compensate the User.
This document takes effect for the User from the moment of using the Payment Station, its use implying full acceptance of these Terms and Conditions.

In order to identify and promptly resolve the request or complaint, the User will provide, as appropriate, information regarding:
Any User of Payment Stations may submit a complaint to SelfPay as soon as he/she becomes aware of the disputed event, through any of the channels provided for in Section 20.1.
The deadline for registering a complaint is a maximum of 3 (three) business days from the date of its receipt by SelfPay. For complaints submitted verbally (by telephone, through Customer Service), the User may request the registration number assigned to his/her complaint.
SelfPay will send the User a reasoned response to the complaint within 15 (fifteen) business days from the date of receipt of the complaint. SelfPay will issue the response in writing, by e-mail or by post, to the address specified by the User, or, as the case may be, verbally, as agreed with him/her. In order to facilitate the resolution of the complaint, SelfPay may request additional information from the User.
For complaints that require complex investigations, including obtaining information or confirmations from acquiring banks, partner banks, card schemes, payment beneficiaries, suppliers or other involved third parties, as well as when the information or documents provided by the User are incomplete, the response deadlines may be extended. In this situation, the User will be contacted by SelfPay within 5 (five) business days from the date of receipt of the complaint and will be informed of the intermediate stage of resolution.
For any dispute arising from or in connection with a complaint not resolved amicably, the Consumer User may address the National Authority for Consumer Protection (https://anpc.ro), alternative dispute resolution entities, under the terms of the law, as well as the competent courts, according to Section 19.
Purchase of Lotto game tickets through SelfPay Payment Stations
This Annex regulates the specific conditions applicable to the purchase of Lotto game tickets through SelfPay Payment Stations and constitutes an integral part of the Terms and Conditions of use of SelfPay Payment Stations.
Within this service, SelfPay acts as an agent of the organizer, the National Company “Romanian Lottery” S.A. (“Romanian Lottery”). The relationship regarding participation in gambling is established between the User and the Romanian Lottery, under the terms of its game regulations.
SelfPay’s policy regarding minors’ access to gambling is strict. It is completely forbidden to use this service by persons under the age of 18.
In order to purchase a game ticket through SelfPay Payment Stations, the User must expressly confirm that he/she is 18 years old, by entering his/her PIN at the Payment Station. Also, if Customer Service has suspicions regarding the player’s age, this is reported immediately so that additional checks can be carried out, and the tickets thus purchased will be considered cancelled.
Immediately after printing the game ticket, the User must check the conformity between the selected options and those printed by the Payment Station, as well as the correct printing of the barcode and the draw date. No subsequent complaints or claims on these aspects will be taken into account.
In the event that, for objective reasons (lack of paper, technical failure or other causes beyond the control of the User), the Payment Station does not issue the Lotto ticket related to the transaction made, the User has the right to request its reissue, in compliance with the conditions below.
The reissue request is immediately sent to SelfPay Customer Service:
The request must contain, as a mandatory requirement, the following information necessary to identify the transaction: (a) the telephone number entered in the initial transaction; (b) the date and time of the transaction; and (c) the number of the Payment Station at which the transaction was made.
Requests for the reissue of the Lotto ticket may be submitted to SelfPay no later than the date and time of the Lotto draw in which the User participated with the respective ticket. Any complaint, request or claim made after the date and time of the draw will not be taken into account, the User being deprived of the right to request the reissue of the ticket or any other remedy in relation to the respective transaction.
If, for reasons beyond the control of the Romanian Lottery or SelfPay, tickets played in the SelfPay Payment Station network could not be imported into the central system of the Romanian Lottery in order to be included in the draw for the period for which they were purchased, they are considered cancelled. Cancelled tickets will be announced before the draw date on the website www.loto.ro.
Refunds of the amounts collected for cancelled tickets will be made exclusively by SelfPay. Refund requests can be submitted by calling the support number 021.529.7101, during office hours (M–F: 08:00–21:00; S–S and public holidays: 09:00–17:00), or by sending an e-mail to contact@selfpay.ro.
Refunds of cancelled tickets are made by:
(a) re-doing the transaction and printing a new ticket; or
(b) bank transfer to the account of the persons presenting the original ticket. The original ticket will be sent by post/courier to the headquarters of SelfPay S.A. at Bd. Dacia no. 153–155, floors 5–7, district 2, Bucharest.
Purchase of electronic money and funding of electronic money accounts
This Annex regulates the specific conditions applicable to the acquisition of electronic money (including in the form of vouchers) and the funding of electronic money accounts through SelfPay Payment Stations and constitutes an integral part of the Terms and Conditions of use of SelfPay Payment Stations.
Through Payment Stations, the following services related to electronic money products issued by authorized issuers can be accessed, depending on availability:
The issuers mentioned above provide services on the territory of Romania in accordance with the applicable legislation on the freedom to provide services. The list of available services may be updated periodically, depending on SelfPay’s contractual relationships with the relevant issuers.
Within these services, SelfPay acts exclusively as a distributor of the electronic money issued by the relevant issuer, collecting the related amounts from the User and transferring them to the issuer, in accordance with the distribution contracts concluded with it.
The electronic money is issued by the relevant issuer, and the contractual relationship regarding the electronic money product (including use, redemption, expiration and any related rights) is established directly between the User and the issuer, based on the issuer’s terms and conditions, available within the purchase flow and/or on the issuer’s website.
SelfPay does not own, manage or have access to the Users’ electronic money accounts and does not provide payment services to Users in connection with these operations.
The services provided in this Annex are intended exclusively for persons who have reached the age of 18.
Transactions related to electronic money products are subject to transaction limits set by issuers and/or SelfPay, automatically applied in SelfPay systems. Transactions exceeding the applicable limits cannot be accepted.
By accepting the terms and conditions of these services, the User undertakes to enter, prior to completing the operation, a valid e-mail address that he/she can access. SelfPay will send the purchased code to the e-mail address specified by the User. The User is solely responsible for entering an invalid e-mail address or one to which he/she does not have access. The need to enter a valid e-mail address is also justified for the objective situation in which, for various technical reasons, the Payment Station does not issue the receipt.
To recover an unprinted or lost receipt containing a PIN code for an electronic money product (PaySafeCard/AirCash ABON) purchased from a SelfPay Payment Station, the User will provide: (a) the e-mail address entered in the transaction; (b) the location or number of the Payment Station where the purchase was made; (c) the amount paid and the value of the banknotes inserted; and (d) the date and time of the transaction.
SelfPay reserves the right to refuse to reissue a code if, on various other occasions, the User has been informed about the importance of entering a valid email address to which he has access, as well as the right to request additional documents or information for the validation/identification of the User.
Complaints regarding the operation of the Payment Station and the collection of amounts shall be addressed to SelfPay, in accordance with Section 20 of the Terms and Conditions of Use of Payment Stations. Complaints regarding the use, operation or redemption of electronic money products shall be addressed to the relevant issuer, in accordance with its terms and conditions; SelfPay shall forward to the relevant issuer the notifications received from Users regarding the transactions carried out at the Payment Stations, in accordance with the contractual mechanisms agreed with the issuer.
SMS information service
This Annex regulates the specific conditions applicable to the SMS information service available at SelfPay Payment Stations and constitutes an integral part of the Terms and Conditions of use of SelfPay Payment Stations.
SelfPay may provide Users with an independent service, for a fee, through which they are informed, depending on the service chosen, about the declared winning variants of the gambling games belonging to the gambling organizers, about the expiration date of the purchased road vignettes or other information specific to the chosen service.
The information is provided through SMS messages sent by SelfPay to the phone number entered by the User at the Payment Station at the time of the transaction in question.
The Service can be purchased from the Payment Stations using the same purchase and payment methods applicable to the other services. All procedures regarding payments, the remainder, the provision of the payment document and the resolution of complaints, applicable to the other services, apply mutatis mutandis to this information service.
The SMS information service regarding the winning numbers of the Romanian Lottery is exclusively informative and does not replace checking the results on the official channels of the Romanian Lottery.
The information, SMS messages and notifications sent regarding the road vignettes, vignettes or any other products or services purchased are informative and do not replace the documents issued by the supplier or the verification of the validity of the purchase through the official channels of the supplier or the competent authority.
Although SelfPay takes reasonable care to ensure the accuracy of the information, material errors or delays may occur (including human errors in the retrieval/entry of data). SelfPay cannot be held liable for such errors or for the consequences arising from the use of the information, except in cases of intent or gross negligence. The user remains responsible for checking the results on the official channels of the relevant organizer before making any decision.
If, for reasons beyond SelfPay’s control, certain notifications in this category contain errors, SelfPay may reissue correction notifications on the same flow through which the initial notifications were transmitted.
SelfPay has the right to temporarily suspend the provision of this service if there is no technological possibility to perform it and is not responsible for interruptions caused by technical problems or works necessary in order to maintain the operating capacity or to modernize the systems, nor for delays or unavailability caused by third parties or force majeure situations (including malfunctions of mobile networks, unavailability of official sources, interruptions of provider services).
SelfPay declines any responsibility regarding the transmission of information in the event that: the telephone number entered in the transaction has been used fraudulently by unauthorized third parties; the User has a defective phone or an invalid telephone number; the messaging service is not activated or overloaded; the number is suspended (including due to fraud or non-payment); the roaming service is not active; or for any other situations in which the User cannot receive SMS messages.
Specific conditions regarding partner products and services distributed through SelfPay Payment Stations
This Annex is an integral part of the Terms and Conditions of Use of SelfPay Payment Stations and establishes the specific conditions applicable to the purchases of products and services of SelfPay partner suppliers (“Suppliers”), distributed through the Payment Stations under the terms of Section 7.6 of the Terms and Conditions.
Through the Payment Stations, SelfPay offers Users the possibility to purchase products and services belonging to the Suppliers, acting as a distributor or intermediary, pursuant to the distribution and/or intermediation contracts concluded with them.
SelfPay may act, as the case may be, in the name and on behalf of the Supplier or as an independent distributor that resells the Supplier’s products. The capacity in which SelfPay acts for each category of products or services is indicated within the purchase flow in the Payment Station interface.
Unless expressly stated otherwise, SelfPay is not the supplier of the product or service distributed and is not responsible for its content, quality, conformity or execution.
By completing a purchase at the Payment Station, the User enters into a direct contractual relationship with the Supplier of the respective product or service, under the conditions established by the latter. The Supplier’s terms and conditions applicable to the purchase are brought to the User’s attention during the purchase flow, prior to the completion of the transaction, and are deemed accepted at the time of order confirmation.
The price of the distributed products and services is displayed in the Payment Station interface at the time of purchase. SelfPay does not charge the User any additional fees or charges for the distribution service, except in cases where this is expressly indicated in the purchase flow. Payment is made in full at the time of purchase, through the payment methods available at the Payment Station. Confirmation of payment also represents confirmation of the order.
Upon successful completion of each purchase, the Payment Station issues the Payment Confirmation, in accordance with Section 4.5 of the Terms and Conditions. The Payment Confirmation is for informational purposes only and certifies exclusively that the payment was made through the Payment Station. It does not represent a tax receipt within the meaning of tax legislation and does not substitute the documents issued by the Supplier (invoice, tax receipt, order confirmation, etc.), if applicable.
The delivery or provision of the purchased product or service is the sole responsibility of the Supplier, under the conditions and terms established by it. Depending on the nature of the product, delivery may take place immediately at the Payment Station (for example, by printing a code on the Payment Confirmation, by sending it to the e-mail address indicated by the User or by directly activating the service).
Unless expressly stated otherwise, any issue regarding the delivery or provision of the product/service will be addressed directly to the Supplier, through the contact channels indicated within the purchase flow or in its terms and conditions.
According to art. 3 par. (3) of Government Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with professionals, the provisions applicable to distance contracts (including the 14-day right of withdrawal) do not apply to contracts concluded through vending machines or automated commercial premises, a category to which SelfPay Payment Stations belong. Consequently, the legal right of withdrawal does not apply, in principle, to purchases made through Payment Stations.
Independently of the above, certain categories of products would in any case be exempted from the right of withdrawal according to the applicable legislation, in particular digital content delivered immediately, products issued or activated at the time of purchase (e.g. recharge codes, vignettes, vouchers) and tickets for events with a fixed date.
To the extent that the Provider voluntarily offers a return or refund policy, it shall apply under the conditions established by the Provider and communicated to the User within the purchase flow or in the Provider’s terms and conditions.
SelfPay does not process returns or refunds for distributed products or any requests in connection therewith. Requests for return or refund shall be addressed directly to the Provider, according to its policy.
Complaints regarding the quality, conformity, delivery or any other aspect related to the product or service distributed are addressed directly to the Supplier, to the contact details indicated in its terms and conditions or within the purchase flow.
SelfPay may provide technical support to the User in relation to the operation of the Payment Station and the purchase process, but does not have the competence to resolve complaints regarding the Supplier’s products or services.
Any complaint regarding the payment through the Payment Station may be addressed to SelfPay, according to the procedure set out in Section 20 of the Terms and Conditions.
SelfPay will make reasonable efforts to assist the User in analysing and resolving the reported problems, including by facilitating communication with the relevant Suppliers.
Since the Payment Stations provide a wide and varied range of intermediated/distributed products and services, before confirming the order, the User is shown, to the extent applicable, essential information regarding the selected product or service and the relevant conditions for carrying out the transaction.
The products and services distributed through the Payment Stations may be subject to terms and conditions, policies, restrictions on use or other commercial conditions established by their Providers. These conditions are established exclusively by the Providers and are available through their communication channels (such as the website or other official channels). The User is obliged to consult them before purchasing the product or service through the Payment Station.
Confirming the order at the Payment Station implies: (a) confirmation that the User has taken note of the information displayed within the purchase flow; (b) acceptance of the inapplicability or, where applicable, limitations of the right of withdrawal related to the respective product; (c) confirmation that the data entered within the order are correct and complete; and (d) the agreement for the immediate delivery of the product or service, where this occurs at the time of order confirmation.
The commercial conditions applicable to the products and services distributed may be modified by their Suppliers, and SelfPay may update the information displayed in the Payment Stations to reflect such modifications, without the obligation of prior notice. SelfPay is not responsible for the content of the terms and conditions or other policies or any information established or transmitted by the Suppliers.
